Proposed Rules Changes
The State Board of Clinical Social Workers is proposing several changes to various parts of Chapter 877 or the Oregon Administrative Rule. That Chapter currently contains 7 divisions of Rule which relate to Licensed Clinical Social Workers and Clinical Social Work Associates practicing in Oregon.
The Board requests that you review all of the following documents.

Notice of Proposed Rulemaking Hearing. This form identifies the specific areas of the Rule the Board is proposing to change. Please review the information at the bottom of the form in the section Rule Summary. That section also contains information about how you can provide feedback to the Board concerning the proposed changes.
- Statement of Need and Fiscal Impact. This form highlights the possible fiscal and economic impact of the proposed rule changes and an estimated cost of compliance.
- Division 20: Procedure for Certification and Licensing. This document is 19 pages long. The Board is proposing a significant re-write to this division to make it more user-friendly. Some of the proposed changes include: Section 877-020-0008 relating to passing the national licensure exam; Section 877-020-0010 relating to supervision requirements that will continue until a person has passed the licensure exams; and Section 877-020-0020 relating to the fee for an initial license or certificate and the annual renewal fee for LCSWs.
- Division 22: Criminal Records Check. This is a whole new division in Chapter 877 and is 3 pages long. In this division the Board will implement the national FBI fingerprint background check which was authorized by the 2005 Legislature. This rule will require all new applicants to undergo a nationwide criminal records check. The Board might also require a criminal records check of current Associates and Licensees who are the subject of an inquiry by the Board.
- Division 25: Continuing Education Reporting Requirements. This document is 5 pages long and completely replaces the division 25 in the current rule. Once again the Board is proposing a significant rewrite to make the division more user-friendly. One change is that there will no longer be categories of formal and informal continuing education. Instead the division simply talks about the various types of continuing education in section 877-025-0006. Section 877-025-0016 will require licensees to accrue specific hours in the area of ethics.
- Division 30, Sections 0040 and 0100. This document is 3 pages long. Section 877-030-0040 adds “in-patient psychiatric hospitalization or psychiatric day treatment” to the list of categories for which a licensee or associate must inform the Board. Section 877-030-0100 greatly expands the rules related to the maintenance and disposition of client records for those in private practice. The section identifies specific information needed in a client record, and that the record is kept in a secure, safe, retrievable and legible condition. The section also establishes record retention protocols.

Underlined wording is new wording that is being added to the rule with this rule change. Wording in [Italics and brackets] is wording that is in the current rule and will be deleted.)
