Reporting Forms





This portion of the Criminal Justice Commission site contains forms and instructions to be used for reporting drug forfeiture proceedings and the resultant distribution of proceeds to the Asset Forfeiture Oversight Advisory Committee.

Current Asset Forfeiture Reporting Forms and Instructions are available below. Please note that  all forms should be sent to: Criminal Justice Commission, 885 Summer Street NE, Salem, OR 97301.

General Fund Contributions from the distribution of proceeds from Criminal Forfeiture:

Payments to the State of Oregon General Fund from criminal forfeitures (which are in addition to the contributions to the Oversight Committee and the Dept. of Environmental Quality drug lab clean-up funds) should be made out and sent to the Department of Administrative Services, 155 Cottage St. NE U90, Salem, OR 97301, with the note: "Attn: Susan Taylor / from Criminal Forfeiture."




AFOAC reporting forms are available here in Microsoft Word and Adobe Acrobat (.pdf) formats. These forms became effective on January 1, 2002. Please remember that we still need to have a copy of the judgment filed with Form 1. Form 2 must now be filed for all forfeitures, not just for those netting over $10,000. Form 4 is unchanged. The forms were updated on 14 August 2002 with the new mailing address. It is not necessary to use the updated form, but please be sure to use the updated mailing address as the forwarding service is limited, may cause excessive delays, and is unreliable.


Form 1 / Seizure Information

  • Form 1 should now be filed for every forfeiture proceeding, whether arising from controlled substances or other prohibited conduct. It should be filed by forfeiture counsel as soon as possible after the final judgment is obtained. It should not be held pending resolution of any sale or distribution of assets. A copy of the judgment must accompany the form.


Form 2 / Asset Distribution

  • Form 2 now should be used to report the distribution of funds from any forfeiture, not just those where the net proceeds exceed $10,000 as before. It should be filed as soon as possible after costs are paid and net assets are distributed. It should be filed by forfeiture counsel as soon as possible after the final judgment is obtained. Information on this form is advisory in nature, and amounts reported need not exactly match estimates on Form 1 or amounts reported on Form 3 or Form 4.


Form 3 / Local Government Use of Proceeds - Annual Report

  • Form 3 must be filed by every "political subdivision of the State of Oregon" that received forfeiture proceeds. It should be filed by local government personnel by December 15 for the last ending fiscal year. It is used to report how the proceeds of forfeitures are used. After 1 January 2002, it must be filed for all proceeds, not just those from drug law violations.


Form 4 / AFOAC Fund Contribution Report has not changed

  • No additional instructions for Form 4 are necessary.
  • Contributions to the Asset Forfeiture Oversight Fund should accompany Form 4 and should be paid on a quarterly basis. The information on Form 4 is used by the Committee to "close the case" on forfeitures reported on Form 1. Therefore, it is important that the Agency Case Number reported on Form 1 match exactly the Agency Case Number reported on Form 4. Every case reported on Form 1 should eventually have a matching entry on a Form 4, either with an accompanying payment or with an indication that there were no net proceeds (costs exceeded proceeds or forfeiture was declined).
