Privacy & Information Disclosure
This policy is intended to provide a framework for ensuring that the state web portals comply with the ORS requirement for the public disclosure of information collected from citizens who interact with their portals.

Reference - ORS 192.420: Right to inspect records public records.  (1) Every person has a right to inspect any public record of a public body in this state, except as otherwise expressly provided by ORS 192.501 to 192.505.

Whenever information is collected about or from users of state agency web portals, the user will be informed of the rules that govern access to that information.


Each agency is responsible for observing specific exemptions from disclosure that apply to records in their custody. One of the following guidelines must be used for their web portal.

  • Agencies may use the privacy statement posted to the Oregon.gov portal as a model for their statements.
  • Agencies may publish a general access/privacy statement.
  • Agencies may itemize records and information exempt from disclosure (on their web sites) and/or they may link a disclosure/privacy statement from each page where information is collected.
  • Agencies may publish instructions on gaining access to records in their custody.
