FMLA and OFLA
Introduction
 
The Federal Family and Medical Leave Act (FMLA) and Oregon Family Leave Act (OFLA) provides time off work to tend to your own serious health condition, the serious health condition of a family member, for parental leave, for sick child leave, for servicemember caregiver leave, and for military exigency leave. 
 
Federal and state law determine if you are eligible for FMLA and/or OFLA leave, the reasons you may take this type of leave and how much leave you are allowed. 
 
FMLA and OFLA leave is job protected leave. This means that upon return from FMLA/OFLA leave, an employee must be restored to their original or equivalent position with equivalent pay and benefits.The use of FMLA/OFLA leave cannot result in the loss of any employment benefits that accrued prior to the start of an employee's approved FMLA leave. In addition, when covered by FMLA leave, the employer must maintain the employee's health coverage under any "group health plan".
 
The agency is required by law to designate or grant you FMLA or OFLA leave if you are eligible for the leave and the reason for your leave meets the requirements of the law. In all cases, applicable policies, laws and Collective Bargaining Agreements govern the rights and obligations of the agency and its employees. 
 

FMLA and OFLA Information for DAS Employees
 
The Employee Information Packet is a summary of FMLA/OFLA policy and procedures and explains eligibility requirements.
 
Employees must generally give 30 calendar days notice for planned absences (paid or unpaid) related to FMLA and OFLA leave. If unable to request leave in advance due to an emergency or unforeseeable event, let DAS Employee Services know as soon as possible.
Employees must provide enough information so the agency can make a qualifying determination.

DAS Employee Services will require a completed Health Care Provider Certificate form for all FMLA/OFLA events except for that designated as Parental Leave. This form must be returned within 15 days from the date requested or your leave can be denied.
