Welcome Administrator Updates and Agenda Review Withdrawal for Reconsideration of Final Orders Public Comment

Welcome (info/discussion) Chair Hoffman opened the meeting, announcing that:
- Verbal public comment will not be accepted; only written public comments would be accepted by the Board and may be sent to Chérie Taylor.
NOTE: Public attendee Kelly Knivila requested that the Board allow verbal comment. Chair Hoffman declined stating that due to the short time frame for today’s meeting only written comments would be accepted.

Withdrawal for Reconsideration of Final Orders The Board considered withdrawal for reconsideration of the final orders relating to the 2010 and 2011 administrative services only (ASO) agreement pursuant to 183.484(4). Wendy Edwards stated the issue before the board today is a withdrawal for reconsideration of the Board’s final orders issued in March, April, May and June of this year due to technical issues related to our temporary rule filing. She explained that ORS 183.484(4) permits an agency to withdraw its orders for purposes of reconsideration after a petition for review has been filed. The orders being talked about relate to the process by which PEBB would select an ASO provider by renewing its contract with either Regence or Providence: PEBB’s decision to renew Providence choice plan. PEBB’s April 21st final order that would renew its contract with Providence to the statewide ASO provider; PEBB’s April 23rd final order that it would not renew its contract with Regence and the May 20th and June 22nd letters from PEBB to Regence. Bret West moved to withdraw the final orders pursuant to ORS 183.484(4). Paul McKenna seconded the motion. Rocky King offered comment on his support for the public comment process, as well as dialogue with vendors, asking that the Board allow public discussion from vendors and the general public before any further decisions are made regarding the 2010-11 ASO renewal. There being no further discussion, the Board unanimously passed the motion.
