Draft Garnishment Forms
 Under ORS 18.854 the Department of Justice may adopt model forms  for use by state agencies and county tax collectors.  Recent changes to Federal minimum wage and Oregon State Law have impacted the calculation of wages that are exempt from garnishment.  The forms below have been prepared and provided by the Department of Justice.  The Department of Justice is undergoing the rules making process for updates to these model forms under Oregon Administrative Rule Chapter 137, Division 60 Notice of Garnishment Model Forms.  The forms below are draft forms and any questions about the content of these forms should be directed to the Department of Justice following your agency procedures for contact with DOJ.
 
No changes were made to the Garnishee Response forms contained in OAR 137-060-0120, OAR 137-060-0220, OAR 137-060-0320 and OAR 137-060-0420.
 

Garnishments through 12/2007
Federal minimum wage was recently updated and caused a change to the calculation for garnishment wage exemption.  The forms below are for use on garnishments through December 2007.  Please note that these are DRAFT forms and are provided by the Department of Justice for the convenience of state agencies and county tax collectors that issue garnishments.  Text that is to be removed is identified using the Strikethrough function and new language is identified using bold and underline.

Garnishments- January 2008
Beginning January 1, 2008, Oregon Law will supercede the calculation based on the Federal minimum wage and cause the Wage Exemption Calculation to change once more.  The forms below are for use on garnishments beginning January 2008.  Please note that these are DRAFT forms and are subject to the rules making process currently taking place through the Department of Justice.  Text that is to be removed is identified using the Strikethrough function and new language is identified using bold and underline.
