Hardship Permits Toolkit for Employees with Driving Problems
State driving must be safe, legal and courteous.  Agencies are required by rule and policy to assure that drivers on state business have a current, valid license to drive.  A driver´s privileges may be curtailed by their state of residence.  Agencies must decide if the restrictions affect safe and legal driving for official state business. Hardship permits are the most frequent license restriction brought to Department of Administrative Services - Risk Management (DAS-RM).
 
In Oregon, drivers whose license has been suspended due to DUII, an uninsured accident, or other causes must obtain a Hardship Permit before they can drive to and from work or on the job.  Oregon Department of Transportation, Driver and Motor Vehicle Services Branch (DMV) issues Hardship Permits.  Hardship Permits contain limits and conditions on driving privileges.  The permit may require attendance at a drug or alcohol rehabilitation program, or special driver training classes.  DMV may specify the hours of the day the person may drive, places he or she is allowed to drive, routes to take, and specific types of Insurance for Drivers with Hardship Permits.  For more information on DMV's requirements for Hardship Permits, see their Web site.
 
If a state employee with a Hardship Permit needs to drive on state business, their agency will need to follow the State Agency Instructions for Requesting a Certificate of Self-Insurance for an Employee with a Hardship Permit and the Employee Liability Policy, 125-7-202, Amendment 1-202, Ignition Interlock Device.  RM has developed two checklists to assist state agencies with making risk-adjusted business decisions regarding state employees with Hardship Permits: 1) State Agency Risk Assessment Checklist for Hardship Permits; and 2) State Agency Loss Control Plan for Hardship Permits.  In addition, we have provided information to assist state agencies with issues and decisions around Ignition Interlock Devices
