Drivers seeking a Hardship Permit from the Oregon Department of Transportation, Driver and Motor Vehicle Services Branch (DMV) will need to produce proof of insurance in the form of an SR-22 filing. An SR-22 filing is a type of insurance certificate from an Oregon-licensed insurance company certifying that the employee has purchased liability insurance that meets the minimum required limits of coverage (ORS 806.070 and 806.075).
The insurance certificate and Hardship Permit restrictions must match. This insurance must cover all vehicles operated by the employee and/or registered in their name. The insurance must specifically agree to cover the permit holder while driving for business or for driving a vehicle owned by another (non-owned vehicle). The certificate will likely not have this information. Therefore, if an employee will be driving their own vehicle on state business, it is important for you to review their insurance policy to determine if the employee has purchased insurance that covers business use. If business coverage is not purchased by the employee, it may result in denial of a claim that arises out of the employees business use.
The state provides self-insurance for operation of state owned vehicles. Private insurance is not sufficient for driving a state car. State employees who request a Hardship Permit for on-the-job driving will need approval from their agency. DMV will look for a Certificate of Self-Insurance for Restricted Driving issued by the Department of Administrative Services - Risk Management (DAS-RM.)
Employees may want to drive a private vehicle for official state business. State self-insurance is "excess" over private coverage when an employee drives a private vehicle for official state business. If an employee is seeking a Hardship Permit, you must be sure their private insurance covers business driving in that private vehicle. Also, you must still request a Certificate of Self-Insurance for Restricted Driving from DAS-RM to cover the "excess" liability exposure.
