Agencies have the obligation to assure that state driving is safe, legal and courteous. Hardship Permits are a red flag to agencies that this employee’s driving requires closer attention. Before we will issue a Certificate of Self-Insurance for Restricted Driving, we need to see a written loss control plan. Here is what we look for:

1 - Does the plan assures public and employee safety?

2 - How will the plan be monitored the entire time the Hardship Permit or driving restrictions are in place?

3 - Your agency must give the driver counseling on its expectations for safe and legal driving. The agency shall give the driver a copy of the Vehicle Rules for State Drivers and any agency rules, polices or conditions the agency attaches to its acceptance of the Hardship Permit.

4 - By rule, the driver must complete, or have completed in the preceding 12 months, a safe driving training course.

5 - Outline measures that specifically address the behavior that caused the loss of driving privileges. The following are a few ideas to consider for your loss control plan.
- Face-to-face meetings with the supervisor at the beginning and end of the shift to assess the employee´s condition and behavior.
- Unannounced spot checks performed by the supervisor at different times throughout the shift.
- Driving only when absolutely necessary or subject to prior review and approval by the supervisor.
- No incidental driving for errands or travel to trainings or meetings.
- You may not allow the driver to transport clients or co-workers.
- You may restrict the type of vehicle driven.

6 - Does the employee transport clients or other passengers?
- By rule, you must grant prior approval before employees can transport passengers on state business.
- Include strict restrictions in the loss control plan. Consider approval of passengers only when absolutely necessary, or subject to prior review and approval by the supervisor.

7- How will the employee be held accountable to follow the plan?

8- If your agency will allow the employee to drive a private vehicle on state business, include proof of automobile liability coverage for the employee´s vehicle.
- Insure that the insurance specifically allows the driver to drive for business purposes and covers the private vehicle(s) that will be used.
- State excess liability coverage may not apply if you fail to provide proof of insurance to DAS-RM.

9 - Notify DMV, Driver Suspension Unit, and DAS-RM when the employee is reinstated with a regular license or when he or she leaves your employment.
