Filing Timelines updated for 2016 Affordable Care Act files

The Division has updated the 2016 filing timeline for Individual and Small Group Major Medical and Pediatric Dental form, rate and binder filings.

TRIA2015

To file forms for TRIA2015 in Oregon, please follow the below steps:

All Forms are Prior Approval. Please file forms by the line of business they belong to. If a form meets the definition of multi-line, it can be filed using CMP coding. The program name should state TRIA2015. Only TRIA2015 forms are to be sent in the Form Schedule tab - nothing else. Oregon will provide an expedited review for all TRIA2015 form filings. Please Do NOT use the NAIC expedited filing transmittal document. It is not necessary in SERFF for Oregon. The Insurance Division will issue a formal bulletin on this subject.

2016 Health benefit filing timelines

The 2016 health benefit form, binder, and rate filings timeline has now been posted to our website.

The Oregon Insurance Division doesn't anticipate any major changes to the timeline, however, we will respond accordingly to changes in federal due dates. The timeline anticipates a CMS deadline of July 20, 2015 for submission of revised plan data. The Oregon Insurance Division also assumes that the templates, out-of-pocket maximums, and AV calculator will be available by the end of March.

Association training rescheduled

Due to scheduling conflicts and continued ACA review the Oregon Insurance Division is rescheduling the Association training from September 23, 2014 to November 6, 2014 from 1:00 - 3:00 PM (Pacific). SERFF public access to all form and rate filings now available

The State of Oregon has insurance company rate and form filings which are available for public review. To make these filings accessible to interested parties via the Internet, the Oregon Insurance Division is utilizing the NAIC System for Electronic Rate and Form Filing Access interface. To access this information, please follow the below link, select SERFF Filings on the right side of the page, then select the access link to SERFF and follow the instructions from there. Association Filing Training to be rescheduled

The division is postponing its Association Training originally scheduled for July 21, 2014. The training has been tentatively rescheduled for September 23, 2014 from 9-11AM PST.

Updated product standards for modification and discontinuances on health benefit plans now posted.

Revisions to the product standards account for the new uniform modification requirements found in CMS 9949-F. These product standards are for use with all individual and small group health benefit plans. Modification and discontinuance information for large group products will be available later this year.

Property and Casualty form filing training

The Oregon Insurance Division Rates and Forms Unit recently sent out a survey regarding future property and casualty training. We have received several responses that are not from rate and form filers or insurers. Our anticipated audience was insurance company filers, third party filers, filing consultants, and underwriters or product development specialists. The training is not intended to provide Continuing Education Credits, or to address other issues that may be of interest to Producers. The Oregon Insurance Division is changing the filing due date for medical rate filings to Monday, June 2, 2014. All other dates remain unchanged. Please see the attached revised Timeline.

We make this change in order to avoid any confusion a due date that falls on the weekend may cause. Please let me know if you have any questions.

The typo in the announcement from SERFF (copied below) may have been confusing. The corrected version below replaces the word not where the announcement read note. Understandably everyone is anxious to get started on the binders, but waiting will avoid delays caused by jumping in before SERFF is ready.

ANNOUNCEMENT SENT APRIL 18TH FROM SERFF PLA​N MANAGEMENT

Template Information:
The 2015 Federal Plan Management Data Templates have now been posted to www.serff.com/hix. The link can be found on the lower right side of the page. Template instructions and further information will be posted there as SERRF receive them.

Note: Although the templates are posted, they have not yet been configured in SERFF and will not be functional for validation through SERFF until late May. For that reason, we are encouraging issuers not to build any SERFF Binders for 2015 until they receive further notice. Issuers who create 2015 Binders will have to re-build them after everything is configured. Issuers should be begin working on the templates outside of SERFF and using the internal template validation as soon as possible to minimize delays down the road.

SERFF Update:
We have also received several questions about closed Binders no longer showing on the Plan Management tab in SERFF. With the release of SERFF 6.7 last night, closed Binders have been moved out of the main view. Users may find these Binders by using the search functionality under the Plan Management tab.

Affordable Care Act (ACA) deadlines require us to assign the highest review priority to ACA products (small group and individual health benefit plans and pediatric dental).

From late April until mid-August, we will review filings for non-ACA health products (forms/contracts and rates) as time permits, but these reviews will be delayed as ACA products must be reviewed first. We regret these delays. Once the ACA product reviews are completed, we will focus resources to the review of non-ACA product filings.

The still open question about when templates will be available from CMS, and subsequently go live in SERFF, prompted the Oregon Insurance Division to change binder due dates for individual and small group 2015 filings. Considering the later open enrollment start date for 2015, and after consultation with Cover Oregon, we believe OID staff can manage these later binder due dates.

The attached Timeline for Form, Binder, and Rate Filings for Individual and Small Group revises the previous (2/10/14) Timeline by:

  • Moving the due date for all medical binders from April 30 to June 30, 2014.
  • Moving the due date for all dental binders from May 31 to June 30, 2014.
  • Moving the SBC upload date from July 15 to August 15, 2014.
  • Moving the revised rate template and documents update from August 15 to September 15, 2014.

The due dates for rate filings are unchanged: individual dental rates due April 30, 2014 and all medical rate filings due May 31, 2014.

These revised binder due dates will not be revised again to earlier dates. It is remotely possible, should template availability be even more delayed, that dates would be pushed later. However, these dates reflect a worst-case expectation about template availability and should not need to be changed again. Should templates become available earlier, carriers that chose to could always submit binders earlier than the required due dates.

Our hope is that these later dates increase certainty about dates that must be met, allowing everyone to plan workload and personal lives accordingly.

Please take a minute to let us know how we did and how we can continue to improve. Any pages from our old website that you may have bookmarked will need to be updated as all the url's have changed.

After a recent update from SERFF staff, we expect the CMS templates will be available later than previously projected. As a result, we are rescheduling the medical binders training from March 20 to April 15 and expanding the training time from 1:30-4:00 p.m. We hope to give more accurate and complete training once the new CMS templates are available. We expect that we will be pushing out the medical binder due date. However, we have not yet set a new due date and probably will not until we officially have a better estimate of when the templates will be available.

The Oregon Insurance Division's health analysts are providing a series of training sessions to help form and binder filers through the upcoming 2015 filing season.

We strongly encourage that the appropriate company personnel attend these trainings-the filers, product personnel, contract personnel, third-party filers, or any company personnel that actually work on the filings themselves.

These training sessions will consist of very specific information, not general introductory information. They are meant for seasoned filers and we will be either highlighting new information or providing information and direction to avoid common issues we experienced last year. If you would like more of an introductory training, please contact the division for a company-specific meeting at 503-947-7983 or dcbs.ratesforms@oregon.gov and ask for the health analyst assigned to your company.
