Limits of liability

Worksite Redesign Technical Advisory Project

This publication is intended to be used solely as a guide for suggested design modifications to improve the safety of residents and employees providing services in a community residential facility. The opinions expressed herein reflect those of the worksite redesign advisory team and are not intended to establish mandatory design requirements. Users of this manual are referred to the applicable Oregon administrative rules, zoning ordinances, building codes or other local regulations concerning design or construction standards. To the extent that those standards conflict with any provision contained herein, this manual should not be construed in any way as superseding the applicable design or building requirements.

Neither the State of Oregon, the Mental Health and Developmental Disability Services Division, the Oregon Occupational Safety and Health Administration, or the Worksite Redesign Advisory Team make any representation or warrenty that compliance with any design recommendation contained herein will reduce or eliminate any particular risk of harm to a resident or employee providing care in the residential facility. The State of Oregon, the Mental Health and Developmental Disability Services Devision, the Oregon Occupational Safety and Health Administration, and the Worksite Redesign Advisory Team hereby disclaim any and all such warrenties, either express or implied including warrenties of merchantability and fitness for a particular purpose.

The State of Oregon, The Mental Health and Developmental Disability Services Division, The Oregon Occupational Safety and Health Administration, or the Worksite Redesign Advisory Team shall not be liable for any damages either direct, indirect, incidental or punitive under any cause of action including, without limitation, breach of contract, breach of warrenty, negligence, strict liability, misrepresentation and other torts. The user of this manual, by incorporation of any design recommendation contained herein into any new or remodeled construction, expressly agrees to be bound by the foregoing limitation of liability.
