Native Americans: Oregon might not tax your income

SALEM—If you're a Native American in Oregon, you may not have to pay taxes on your income.

If you earned income in 2008, you may be able to subtract all or part of it on your Oregon tax return. You may qualify for the subtraction if you meet all the following:
  • You worked on federally recognized Indian country (land within reservation boundaries or land held in trust by the federal government); and
  • You lived on federally recognized Indian country in Oregon during the time you earned the income; and
  • You were an enrolled member of a federally recognized American Indian tribe.

Only the income that meets all three criteria may be subtracted. "However," said Pendleton office administrative specialist Louise Beach, "the only way Native Americans can qualify for the subtraction is by filing and reporting their total income on federal and Oregon tax returns."

Native Americans must also fill out a form called an Exempt Income Schedule for Enrolled Members of a Federally Recognized American Indian Tribe and send it in with their Oregon tax returns by April 15, or by October 15 with an approved extension.

The form and instructions are available on the department's website, www.oregon.gov/DOR, or by calling 1-800-356-4222.

"You have to meet all the living and working conditions, and be an enrolled member to get the subtraction, and you have to file a tax return," Beach said.
