Business Claim Criteria
Purpose: Set standards for claims where the owner is a business entity.
Reference: ORS 98.392-396, OAR 141-040-0211 and 141-040-0212
When an authorized employee or officer is claiming on behalf of the business:
1. The secretary of a corporation must provide an original statement with corporate seal designating an authorized corporate employee to represent the business.
2. The authorized employee must
a. Provide a notarized and signed inquiry and/or claim form(s)
b. Present current photo identification either government or corporate OR personal identification (such as driver's license).
c. Provide proof of the business' federal tax identification number or other business identification number.
d. Provide sufficient evidence of ownership to establish the validity of the claim. Evidence may include such documents as listed in OAR 141-040
When an agent is claiming on behalf of a business:
In addition to the criteria listed above, the agent must provide an original power of attorney or notarized document from the corporation's designated employee authorizing the agent to represent the company in the claims process. The authorization must include the name and address of the agent and direction for payment of any property determined to be due the company. If payment is to made to the agent for the benefit of the business, the agent must also provide his/her federal tax identification number.
Agency staff will not discuss any claim or inquiry with an agent until the required authorization documents (as described above) are received.
When Competing claims:
When more than one claim or inquiry is filed on behalf of the business, a letter will be sent to the business describing the situation and providing the identity of the persons making the claim or inquiry and seeking a response from the company designating an authorized claimant. No further action shall be taken and no claim shall be paid until the company has responded.
Business Claim Inquiries:
When an inquiry for multiple business names is received:
Five (5) or fewer names/subsidiaries: Staff will research the names, initiate claims and send forms as needed.
More than five (5) names/subsidiaries: Staff will send letter describing policy and directing claimant to website to conduct search.
