ADMINISTRATIVE LAW JUDGE 1
$4,286 - $5,982 MONTHLY


The Employment Department is recruiting for multiple Limited Duration and one permanent full-time Administrative Law Judge positions.  The positions are located in Eugene,Salem, and Tualatin. The limited duration positions are expected to end on or before June 30, 2011. 
 
These positions are represented by the Service Employee International Union (SEIU). This recruitment may be used to fill future permanent and limited duration vacancies in Eugene, Salem, and Tualatin.  On your PD100, please be sure to mark all geographic locations you are willing to work.
 
The Office of Administrative Hearings (OAH) is a division of the Employment Department.  The purpose of the OAH is to provide trained and proficient Administrative Law Judges to conduct contested case hearings for state agencies, boards, and commissions.  It consolidates the programs, positions, and funding resources of the Hearings Sections of the Employment Department; Driver and Motor Vehicle Services, Department of Transportation; Adult and Family Services, Department of Human Services; Water Resources Department; Workers Compensation and Insurance Division, Department of Consumer & Business Services; Oregon Liquor Control Commission; and the Construction Contractors Board.
 
TO QUALIFY
 
Your PD100 application will be reviewed to verify that you meet the minimum qualifications as stated in this section.  To receive credit, your application must clearly show that you have:
 
Graduation from an accredited law school with a LL.B. or J.D. degree; OR 
Three years experience conducting contested case hearings, including the skills listed below. 
  • Conduct routine administrative hearings for a single agency generally involving a single legal issue and one or two parties.  Understand assigned agency program and non-legal program concepts necessary to analyze specific legal issues brought to hearings. 
  • Ensure that hearings are orderly, conducted fairly, and safeguard the rights of the involved parties. Explain the law and procedure at the start of hearings provide clear expectations to the parties, and assist in the development of testimony. Identify essential facts, issues or potential issues during the course of hearings. 
  • Follow oral and written arguments and identify and apply appropriate law to essential facts and key issues. Write clear, concise, well organized and legally sufficient decisions and orders. 
  • Communicate effectively orally and in writing as appropriate for the needs of the audience. Use logic and reasoning to identify the strengths and weaknesses of alternative solutions, conclusions or approaches to issues. Interpret documentary evidence and testimony. Deal with people under adverse or emotional situations.
 
Past or present bar membership preferred.
 
This position requires successfully passing a criminal record(s) check. The circumstances of any criminal activity will be reviewed to determine whether an applicant is accepted for employment.
 
During the current biennium ending June 30, 2011, Employment Department employees are required to take mandatory unpaid time off (furlough days). A furlough is a temporary excused unpaid absence from work. Upon your arrival, your manager will be meeting with you to determine the number of hours or days required to be furloughed. 
 
POSITION PURPOSE
 
To conduct timely, fair, and impartial one- or two-party contested case hearings.  The Administrative Law Judge (ALJ) works under minimal supervision with considerable latitude for initiative and independent judgment.  The ALJ presides over hearings, ensuring that a complete record is developed, and writes orders accurately deciding all factual and legal issues.
 
DUTIES AND RESPONSIBILITIES
  • Conduct one- or multiple-party contested case hearings. Ensure a fair and impartial process in the development of a complete and accurate record of testimony, exhibits, and jurisdictional documents. Create a quality audio recording of the hearing. Examine witnesses as appropriate. Rule upon all applicable motions relating to evidence, procedure, or substantive issues. 
  • Identify issue(s) in contested case hearings. Review all documents and testimony submitted into evidence. Consider legal arguments of parties and/or their attorneys. Reconcile conflicting testimony.  Make jurisdictional and evidentiary findings as required. Conduct legal research of applicable statues, administrative rules, and case law. Write proposed or final orders with complete findings of fact and conclusions of law. Analyze all findings and applicable law to produce decisions that are factually and legally accurate. Complete orders in a timely manner in accordance with standards established by statute, rule or OAH policy. 
  • Maintain knowledge of relevant law. Attend OAH meetings and trainings, and other duties as assigned.
 
WORKING CONDITIONS
 
There is regular contact with the public, with occasional hostile or uncooperative parties or witnesses. Evening and weekend work may be required. Travel, including overnight stays, may also be required.

A COVER LETTER, not more than three (3) pages, that addresses the following desired competencies, as listed below.  If you do not respond to each of the desired competencies, you may not be offered an interview.  Applicants whose background most closely matches these competencies will be invited to interview. 
  • Strong analytical legal skills
  • Experience multi-tasking and prioritizing task and duties to meet deadlines
  • Ability to communicate both orally and in writing.  Please include both the topics involved and the nature of the audience.
