The Oregon Employment Department is currently recruiting for a full time limited duration Legal Staff to join the Employment Appeals Board team, located in Salem. This position is expected to end on or before June 30, 2011 and is represented by the Service Employee International Union (SEIU). This recruitment may be used to fill future vacancies.
The Employment Appeals Board (EAB) is an agency of the Employment Department that reviews the records of contested case proceedings on claims for unemployment insurance benefits. The Board reviews for errors of fact and law, and promptly issues decisions affirming, reversing, remanding, and modifying decisions of administrative law judges. EAB has one office in Salem, a biennial budget of $1.7 million, three Board members, four legal staff and two legal secretaries.
TO QUALIFY
Your PD 100 application form will be reviewed to verify that you meet the minimum qualification as stated in this section. To receive credit your application must clearly show that you have:
- A Law degree and one year of experience as a Trial Lawyer, as an Appellate Attorney, or conducting administrative hearings; OR
- A Bachelor's degree with courses in Administrative Law and two years of experience in one of the following: preparing, developing, and/or presenting cases before administrative hearings;AND
- conducting contested case hearings.
Three additional years of experience conducting contested case hearings may substitute for the Bachelor's degree.
This position requires successfully passing a criminal record(s) check. The circumstances of any criminal activity will be reviewed to determine whether an applicant is accepted for employment.
During the current biennium ending June 30, 2011, Employment Department employees are required to take mandatory unpaid time off (furlough days). A furlough is a temporary excused unpaid absence from work. Upon your arrival, your manager will be meeting with you to determine the number of hours or days required to be furloughed.
POSITION PURPOSE
The purpose of this position is to draft solid legal decisions consistent with the determination of the voting members, following an efficient and thorough review of the contested case record and deliberations, which the legal staff are expected to facilitate.
MAJOR DUTIES
Case Review:
Review contested case records, including hearing transcripts, exhibits, and other file documents (including arguments and legal memoranda) for substantive and procedural issues, including issues of statutory authority and fundamental fairness.
Review hearing decisions for factual accuracy, legal correctness, and consistency with Employment Department policy. Identify, review, and analyze cases according to all applicable state and federal statutes, administrative rules, regulations, agency rules and regulations, appellate case law, EAB decisions, and Oregon Attorney General opinions.
Petition for Judicial Review and Requests for Reconsideration of EAB Decisions: Review and analyze requests, and petitions, motions and briefs of cases, as assigned by EAB members.
Legal Research and Review:
Monitor amendments to law and policy affecting EAB decisions, including but not limited to amendments to state and federal statutes, administrative rules, and agency rules and regulations. Monitor developments in the law affecting EAB decisions, including but not limited to state and federal appellate decisions, EAB decisions, and Oregon Attorney General opinions.
Research proposed changes to state and federal law, administrative and agency rules, and Employment Department and EAB policy, considering the effect of such proposed changes on EAB's decision-making process, the public interest, and the goals of the Employment Department.
Review rules proposed for adoption by the Employment Department and EAB, and give advice on the effect the rules might have on the work of the Employment Department, EAB, and agency customers. Research legal issues of general applicability as assigned by EAB members consistent with the mission of EAB.
Independent Judgment:
Determine the material legal and factual issues of each case, on a case by case basis, including issues of credibility. Determine what if any legal or factual issues may be necessary to bring to the special attention of the voting members as potentially affecting their initial determination, EAB policy, or Employment Department policy.
Make recommendations and advise EAB members and other legal staff as requested, consistent with the mission of the EAB.
Decision Drafting:
Draft clear, cogent, and legally sufficient proposed final decisons consistent with the applicable law and rules, and the judgment of the panel deciding the case, based on a comprehensive review and analysis of the record of the particular case, including the hearing transcript, exhibits, and other file documents.
WORKING CONDITIONS
EAB reviews a high volume of cases that require specialized knowledge of Employment Department law, general employment law and administrative law and procedures. Daily drafting and editing of written decisions requires knowledge and skill in the use of personal computers and specialized software.
