Oregon RPS, REC System Rulemaking
October 2007 - January 2008
ODOE staff reviewed the work of the Renewable Energy Working Group (REWG), reviewed the statute with legal counsel, and discussed implementation with Oregon Public Utility Commission staff. During the rulemaking process, a public workshop and formal public hearing were held in November and December of 2007. As a result:
  • the Western Renewable Energy Generation Information System (WREGIS) was designated as the entity to track and report Renewable Energy Certificates (RECs); and
  • January 1, 2007 was set as the effective start date for operation of Oregon's RPS tracking system.
 
A petition for judicial review was filed by the Industrial Customer of Northwest Utilities (ICNU) on March 31, 2008.
 
Due to a procedural defect in our Renewable Portfolio Standard "Renewable Energy Credit" (330-150) rulemaking, we had to repeal the adopted rules and re-notice  them. The procedural defect was a failure to file the adopted rules with Legislative Counsel within 10 days following filing with the Secretary of State. The Oregon Department of Justice advised ODOE that there is a significant risk that a court would demand strict, rather than substantial compliance with this provision.
