Metro Urban Rural Reserves Remand

The Department of Land Conservation and Development (DLCD) issued a Land Conservation and Development Commission (LCDC) order approving the Metro Urban and Rural Reserves on August 14, 2012. The LCDC order was appealed to the Oregon Court of Appeals by several parties (Barkers Five, LLC v. LCDC). The Court issued its opinion on February 20, 2014, reversing and remanding LCDC's approval. LCDC remanded the matter to Metro and the counties with an order issued January 15, 2015.

Those who participated in the local proceedings received notice of the adoption from the city and were allowed 21 days to submit an objection to DLCD. DLCD received seven objections (see "Objections," below).

The DLCD director must approve or remand the submittal, or refer it to the Land Conservation and Development Commission (LCDC). (See OAR 660-025-0150.) The director referred the submittal to LCDC for consideration at its November 17, 2017 meeting.
