LCDC Meeting Reports, March 12, 2015

 
Agenda Item 2 – Public Comment
This part of the agenda is for comments on topics not scheduled elsewhere on the agenda. The chair may set time limits (usually three minutes) for individual speakers. The maximum time for all public comments under this agenda item will be limited to 30 minutes. If you bring written summaries or other materials to the meeting please provide the commission assistant with 20 copies prior to your testimony. The commission is unable to take action, at this meeting, on items brought to their attention in this forum.
 
The department will provide the commission with a briefing on its draft report reviewing the metropolitan greenhouse gas (GHG) targets rule. The Target Rule (OAR 660-044) commits the commission to review the rule by June 1, 2015 and determine whether amendments to the rule are warranted. The department will present a final report and recommendation to the commission for its consideration at the May 21-22, 2015.
Department and city staff will provide the commission with a status report on the city’s progress toward responding to the commission’s remand of Bend’s 2010 urban growth boundary amendment.
 
Agenda Item 5 – Citizen Involvement Advisory Committee Joint Meeting
The commission will meet with its Citizen Involvement Advisory Committee (CIAC) to discuss the committee’s work program and other matters concerning citizen involvement in land use planning.
 
The commission will present “STAR Awards for Citizen Involvement” recognizing the Aloha-Reedville Study and Livable Community Plan and the City of Portland.
 
The commission will continue its consideration of proposed rules concerning the transfer of M49 development credits and may adopt proposed amendments to rules under OAR 660, divisions, 4 and 27. (Action)
 
Department staff will provide the commission with a status report on progress towards a rule amendment.
   
The commission will be asked to extend the suspension of its remand of the Newberg urban growth boundary amendment to provide time for mediation to be completed.
 
The commission will consider the petitions for review of director’s action in the matter of the remand of the designation of urban reserves by Metro and rural reserves by Clackamas County, Multnomah County, and Washington County.  The commission will hear oral argument, deliberate, and make a decision to affirm, reverse, or modify the action of the director. Oral argument shall be limited to the parties in Barkers Five, LLC v. LCDC.  The time for oral argument may be limited by the chair.  This agenda item is set for a time certain of 3:00 pm, Thursday, March 12, 2015.
 
The commission will receive an update by the director on recent matters concerning the department.
 
Agenda Item 12 – Commission Business
The commission will discuss a department recommendation for the grants advisory committee, meeting dates and locations for 2015, the BAM subcommittee report, and other commission business.
 
Agenda Item 13 – Request to Appeal Pursuant to ORS 197.090(2) and (3), and ORA 660-001-0201 to 660-001-0230 (Placeholder) (Possible Action) State law requires commission approval of a DLCD director’s decision to seek review of a local government land use decision. Only the director or department staff on the director’s behalf, the applicant, and the affected local government may submit written or oral testimony concerning commission approval of a director’s recommendation to file or pursue an appeal, or intervention in an appeal, of a land use decision, expedited land division, or limited land use decision. This item is scheduled as a placeholder as the department does not anticipate making such a request.
