September 2, 2010
On September 2, 2010 the Land Conservation and Development Commission (LCDC) directed the Department of Land Conservation and Development (DLCD) to initiate an administrative rulemaking project to review existing rules governing the siting of large, commercial-scale solar power generation facilities on Oregon’s farm and ranch lands.
A growing interest in solar power has prompted LCDC to review existing rules, which should offer an adequate balance between agricultural lands protection and important power generation projects.
At the same September 2 meeting, LCDC agreed to an advisory committee to advise the department and the commission (see below). LCDC will conduct a formal review of the committee’s recommendations at its regular June 2011 meeting. Based on input and recommendations from the committee, LCDC may adopt new or amend existing administrative rules at that time or choose to maintain the existing rules as written.

In the November 1998 general election, Oregon voters approved Ballot Measure 56 (BM 56). The measure requires cities and counties to provide affected property owners with notice of a change in zoning classification; adoption or amendment of a comprehensive plan; or adoption or change of an ordinance in a manner that limits or prohibits previously allowed uses.
The measure also requires the Department of Land Conservation and Development (DLCD) to notify cities and counties when the legislature enacts a new law or the department adopts a new administrative rule that limits or prohibits otherwise permissible land uses.
