LCDC adopts amendements to urban and rural reserve administrative rules

LCDC to consider rule amendments for Metro Urban and Rural Reserves
A workgroup composed of planners, interest groups, state agencies and other citizens has been meeting since May to consider several concerns about Land Conservation and Development Commission (LCDC) rules pertaining to Metro Urban and Rural Reserves. The rules apply to all land recently designated by Metro and the three metro-area counties as urban reserves or rural reserves.
In response to the concerns under discussion by the workgroup, the draft proposal to amend these rules will be sent to LCDC for consideration and possible adoption at its September 2 meeting in Salem.
The department’s draft includes several options for changing the rules – at this point none of these options are necessarily endorsed by the workgroup or by the department. If LCDC amends the Metro Reserves rules at its September 2 meeting, the amendments would be effective upon filing with the Secretary of State's Office, approximately September 15, 2010.
History
LCDC's rules for Metro Urban and Rural Reserves were adopted in 2008 in response to 2007 state legislation authorizing the designation of such reserves.
In late 2009, concerns were raised by some local governments and other interest groups regarding the rules. These concerns were mainly with respect to portions of the rules that restrict or prohibit future land use changes to land designated as urban or rural reserves.
On April 22, 2010, LCDC held a public hearing to consider these issues and, in response, adopted minor amendments to the rules.
Testimony at that meeting suggested that further amendments to these rules should be considered. LCDC directed the department to convene a workgroup of local governments and other interests in the region to discuss whether additional amendments are necessary or desirable.
The workgroup has met five times since May 27 and will meet once more on August 12. Minutes of the meetings and other materials discussed by the workgroup are posted on this website.
At LCDC’s July 22-23 meeting, the department reported on the progress of the workgroup and recommended that LCDC consider whether or not to adopt additional changes to these rules at its September meeting.
Members of the public are encouraged to send comments to LCDC about these changes and/or to provide testimony at the September 2 meeting.
