Gwendolyn Willmon DC, Final Stipulated Order. Licensee agrees to evaluation and treatment for substance abuse, random drug tests. Violations of ORS 684.100(1) (f) and (g) (A), and OAR 811-035-0015(9) and (13). (1-24-2003)
 
Susan Gray, DC, Final Order by Default. License suspension, for violations of OAR 811-035-0015 (19), OAR 811-035-0015 (20) and OAR 811-015-0006 (1) (failure to release records), and ORS 684.100 (1) (t). Licensee was suspended from Feb. 3, 2003 until Feb. 28, 2003. (1-24-2003)
 
Nicholas Crane DC, Interim Stipulated Order (2-11-2003). Licensee agreed to withdraw from active practice of chiropractic pending outcome of criminal charges in Klamath and Jackson Counties & final disposition of OBCE Notice of Proposed disciplinary action issued 12-17-2002. That Notice proposed license suspension for sexual misconduct and boundary issues for violations of ORS 684.100 (1) (g) (A); OAR 811-035-0015 (1) (a), and 811-35-0005 (2) (informed consent).
 
Jai Debra Tomlin, DC, Stipulated Final Order. Letter of Reprimand for allowing unlicensed person to provide therapies to patients and $194 cost recovery. Violations ORS 684.100 (1) (g) (A) and (C) (n); and OAR 811-035-0015 and (10), (3-7-2003)
 
Gary Jones, CCA Applicant. Final Order by Default. Denial of applicant for certified chiropractic assistant for violation of OAR 811-010-0110 (5). The Board found applicant knowingly provided patient treatments without a valid CCA certificate. (3-26-2003)
 
James Olshove DC, Stipulated Final Order. Two-year probation, $250 civil penalty for practice of needle acupuncture on four patients outside chiropractic scope of practice. Violations of ORS 684.010 (2)(a)(b) and OAR 811-035-0015(4) , OAR 811-015-0005(1), OAR 811-015-0005(1), ORS 684.035 and ORS 684.100(1)(g)(B). (3-12-2003)
 
Allan Burke, DC Applicant, Final Order by Default. Denial of application for license to
practice chiropractic for violations of ORS 684.100 (1)(d), ORS 684.040 (2)(a), OAR 811-010-0055 (3), and OAR 811-035-0015). Applicant has felony conviction for fraud in another state and had his California license to practice chiropractic revoked. (3-18-2003)
 
Trev Wheeler DC, Stipulated Final Order. Two-year probation with chaperone when treating female patients for performing a breast examination without informed consent (following Licensee’s plea of guilty to one count of battery for the same offense). Must also read "Behind Closed Doors" by Angelica Redleaf DC and do book report. Violations of ORS 684.100 (1)(g)(A); OAR 811-035-0015 (1)(a). 811-35-0005 (2) (informed consent), and 684.100 (1)(d) (conviction of a misdemeanor involving moral turpitude) and 684.100(1) (g)(A) (unprofessional conduct). John Platt DC, Stipulated Final Order. Three year probation, continuing education, $3,000 cost recovery for engaging in an sexual relationship with a patient. "The Board finds that Licensee’s conduct as described herein constitutes unprofessional conduct and would be in violation of ORS 684.100 (1)(g)(A); and OAR 811-035-0015 and (1)(a)(b)(c). Licensee denies the allegations but agrees the following order can be entered: Licensee admits to failure to chart note a termination of the doctor-patient relationship in OAR 811-035-0015(1)(B)(d)..." (5-12-2003)
 
Abel Harrington DC, Stipulated Final Order. Two-year probation and $1,000 civil penalty for having sex with a patient. Must also read "Behind Closed Doors" by Angelica Redleaf DC and do book report. Violations of ORS 684.100 (1)(g)(A); and OAR 811-035-0015 and (1)(a)(b)(c). (6-5-2003)

Case # 2003-5005 & 5006., Competency Examinations ordered. (Not a disciplinary action.) Two chiropractic physician with inactive licenses have requested to change to active status. The OBCE has determined they have been out of active practice for over five years and must take the NBCE Special Purposes Examination for Competency (SPEC) pursuant to the authority in ORS 684.100 (5) (6) and (7), and OAR 811-010-0089. OBCE policy is that a doctor seeking active status must have been in practice during the last five years, or the SPEC examination will be required. (5-22-2003)

New Actions --- None to report at this time.
 
Dismissed Complaints -- During this reporting period the OBCE made a determination of no statutory violation (N.S.V.) on eleven cases, insufficient evidence (I.E.) on twenty-nine cases, case closed on two cases.

In all orders, the Board proposes to recover costs associated with the disciplinary proceeding as allowed by ORS 684.100(9) (g). Names of doctors receiving proposed orders of discipline are not published until final action is taken with the exception of proposed orders involving sexual misconduct. This report covers the January 1, 2003 to June 9, 2003 period.
