Food Safety Modernization Act
The Food and Drug Administration (FDA) Food Safety Modernization Act (FSMA) was signed into law on January 4, 2011. It aims to ensure the U.S. food supply is safe by shifting the focus of federal regulators from responding to contamination to preventing it.

Since January 2013, FDA has released seven proposed rules to implement FSMA. A list of these proposed rules and links to the FDA web site for each rule is below. The public comment period has closed on four of the proposed rules, and three of the rules are currently open for public comment. After receiving numerous comments expressing concern about portions of the produce and human preventive controls rules, FDA announced in December 2013 that it intends to revise and re-release portions of these two rules for public comment before they are finalized. FDA estimates that the revised sections of these two rules will be re-released in June of 2014.

The Oregon Department of Agriculture (ODA) has submitted produce rule comments, human preventive controls rule comments, and foreign supplier verification rule comments in consultation with a variety of stakeholders. We are now working on comments regarding the proposed preventive controls rule for animal food and feed.  Please share your questions and concerns regarding FSMA, or about ODA's comments, to Stephanie Page by email or by phone at (503) 986-4558.  In addition, consider submitting your comments directly to the FDA official docket.

Proposed Rules 
The following Food Safety Modernization Act (FSMA) rules are out for comment. Oregon Department of Agriculture (ODA) urges farmers and processors to take a close look at the rules.

Workshops & Events

FDA will hold several public meetings regarding the proposed intentional adulteration and transportation rules. FDA has posted several videos, webinars, and interviews about FSMA on its Web site.
