Process for adopting Oregon Administrative Rules
Checklist for Permanent Rulemaking - Oregon Administrative Rule
  • Appoint advisory committee or use other means to obtain public input, as appropriate
  • Prepare notice including:
    • Date, time, and place of hearing;
    • A short caption describing the rule and its purpose; 
    • A brief summary of the rule;
    • A list of statutes which give the legal authority for the rule.
  • Notices are given to:
    • Specified legislatures;
    • Agency mailing;
    • Secretary of States Bulletin.
  • Hearing(s) is held with opportunity for public to provide:
    • Verbal testimony;
    • Written testimony.
  • Hearings officer will provide a report of the hearing to the director.
  • Substantial objections may cause the proposed rule to be revised.
  • Director signs rule, rule is put in place.
  • Legislature reviews the rule for ratification.
