ODA issues civil penalties for pesticide violations in 2012

Article Content The Oregon Department of Agriculture issued 26 penalties in 2012 in the amount of $49,416 in connection with 20 incidents involving pesticide violations. The penalties stem from investigations performed by ODA’s Pesticides Program. The 2012 civil penalties include the following: - Asplundh Tree Expert Co. of Tigard was issued a $2,849 civil penalty for seven counts of employing unlicensed pesticide applicators.
- Jeremy J. Breyman of Salem was issued a $407 civil penalty for performing pesticide application activities in a faulty, careless, or negligent manner.
- Coastal Farm & Ranch in Albany was issued a $320 civil penalty for offering for sale products in broken containers.
- Crop Production Services, Inc. of Tangent was issued an $888 civil penalty for the sale of a restricted use pesticide to an improperly licensed individual.
- Dennis’ 7 Dees Landscaping, Inc. of Portland was issued a $3,256 civil penalty for eight counts of employing unlicensed pesticide applicators.
- DW Ag Service of Hermiston was issued a $518 civil penalty for performing pesticide application activities in a faulty, careless, or negligent manner. In addition, Dennis A. Winters of Hermiston was issued a $407 civil penalty for his role.
- EZ Orchards, Inc. of Salem and Lorenzo Zepeda of Salem were each issued an $8,000 civil penalty for performing pesticide application activities in a faulty, careless, or negligent manner.
- Michael S. Flood of Hood River was issued a $3,848 civil penalty for performing pesticide application activities in a faulty, careless, or negligent manner.
- Grass Growers, Inc. of Baker City was issued a $2,400 civil penalty for using improperly licensed pesticide applicators.
- Nicholas T. Halousek of Malin was issued a $407 civil penalty for performing pesticide application activities in a faulty, careless, or negligent manner.
- Highlanders Forest LLC of Central Point was issued a $2,700 civil penalty for nine counts of employing unlicensed pesticide applicators.
- Home Depot USA, Inc. in Ontario was issued a $360 civil penalty for offering for sale products in broken containers.
- JR Simplot Company of Boise, Idaho was issued a $1,998 civil penalty for the sale of restricted use pesticides to an improperly licensed individual. The company was also issued a $1,440 civil penalty for the sale of unregistered pesticide products.
- Mark D. Lafayette of Dallas was issued an $814 civil penalty for performing a pesticide application activity in a faulty, careless, or negligent manner.
- Alex Lagunas of Klamath Falls was issued a $7,215 civil penalty for performing pesticide application activities in a faulty, careless, or negligent manner.
- Mid-Columbia Producers, Inc. of Moro was issued a $444 civil penalty for intentionally or willfully applying a pesticide product inconsistent with its labeling. Ken R. Dunn of Wasco and Paul M. Keyes of Dufur were each issued a $407 civil penalties for their role in the incident.
- Oregon Field Spraying LLC of Carlton was issued a $407 civil penalty for performing pesticide application activities in a faulty, careless, or negligent manner. Eric J. Kuehne of Carlton was issued a $407 civil penalty for his role.
- Trugreen Landcare LLC of Tigard was issued a $555 civil penalty for employing an unlicensed pesticide applicator.
- Univar USA, Inc. of Portland was issued a $407 civil penalty for the sale of a restricted use pesticide to an improperly licensed individual.
- Sheldon Virgin of Keizer was issued a $555 civil penalty for performing a commercial pesticide application without a license.
