ODA issues civil penalties for CAFO and agricultural water quality violations in 2012

Article Content The Oregon Department of Agriculture issued 13 civil penalties in 2012 in the amount of $28,740 for violations related to confined animal feeding operations (CAFOs). In addition, ODA issued five civil penalties in 2012 in the amount of $4,360 for violations associated with the Agricultural Water Quality Management Program. The violations generally involve problems with animal waste management leading to water pollution. The CAFO civil penalties include the following: - February 3, 2012, Chris DeVries of DeVries Dairy in Marion County was issued a $720 civil penalty for failing to keep records and making them available as required by the permit.
- June 29, 2012, Flavio DeCastilhos of Tumalo Farms in Deschutes County was issued a $680 civil penalty for failing to submit an annual report.
- June 29, 2012, Wayne Woods of Woodstock Dairy in Tillamook County was issued a $760 civil penalty for failing to submit an annual report.
- June 29, 2012, John Esplin was issued a $680 civil penalty for his facility in Tillamook County for failing to submit an annual report.
- June 29, 2012, Ryan Bradford of Ryan Bradford Feedlot in Malheur County was issued a $680 civil penalty for failing to submit an annual report.
- June 29, 2012, Pete Captein of Captein Dairy in Malheur County was issued a $720 civil penalty for failing to submit an annual report.
- July 2, 2012, Arie and Joel Slegers of Slegers, Inc. in Yamhill County were issued a $4,320 civil penalty for discharging manure into waters of the state.
- July 12, 2012, Oregon State University Dairy Center in Benton County was issued a $6,920 civil penalty for discharging manure to surface waters of the state.
- July 20, 2012, Kenneth Maack of Dairy 101 LLC in Tillamook County was issued a $1,480 civil penalty for failing to follow the facility’s approved animal waste management plan and failing to provide proper facility records.
- July 24, 2012, Wayne Johnston of Southfork Dairy in Tillamook County was issued a $1,420 civil penalty for failing to contain manure in the production area resulting in contaminated storm water leaving the barns, allowing contaminated storm water to discharge into waters of the state, and for improper operation and maintenance of a wastewater storage facility.
- August 14, 2012, Delmer Brink of Rogue View Dairy in Josephine County was issued a $2,920 civil penalty for allowing waste water to escape the facilities and enter waters of the state, and for failing to properly operate and maintain the manure collection, transfer, and application systems.
- August 14, 2012, David Lamont of Featherland Farms, Inc. in Lane County was issued a $2,880 civil penalty for failing to apply waste in accordance with proper agricultural practices by applying manure to standing water and saturated soils, and for failing to implement an approved animal waste management plan.
- September 10, 2012, Charlie Eggert of Rock Ridge Farms, LLC in Marion County was issued a $4,560 civil penalty for discharging liquid manure to surface waters of the state.
The following civil penalties are in connection to ODA’s Agricultural Water Quality Management Program: - February 13, 2012, Roy Milhous in Deschutes County was issued a $320 civil penalty for placing livestock wastes where it would pollute ground water in an area identified as a ground water management area.
- September 11, 2012, Raymond Halsey in Lane County was issued a $580 civil penalty for placing livestock wastes where it would pollute ground water in an area identified as a ground water management area.
- September 11, 2012, Whispering Winds Equine Rescue in Douglas County was issued a $1,360 civil penalty for placing livestock waste where it was carried off the property to a stream and for degradation of riparian vegetation.
- October 26, 2012, Evergreen Agricultural Enterprises, Inc. in Yamhill County was issued a $1,200 civil penalty for plowing up riparian vegetation adjacent to a farm field.
- November 26, 2012, Jocelyn and Robert Silver in Polk County were issued a $900 civil penalty, for placing livestock waste where it was carried off the property to ditches that led to a stream.
