ODA issues civil penalties for pesticide vioations in 2011

Article Content The Oregon Department of Agriculture issued 12 civil penalties in 2011 in the amount of $8,917 in connection with 6 incidents involving pesticide violations. The penalties stem from investigations performed by ODA's Pesticides Program.
The 2011 civil penalties include the following:
- J.R. Simplot Company, a licensed commercial pesticide operator headquartered in Boise, Idaho, was issued a $2,516 civil penalty for using a pesticide product in a manner inconsistent with its label and for using an unlicensed pesticide applicator. Alan Blackburn and Chad Blackburn, both of Hermiston, were each issued a $444 civil penalty for their roles in the incident.
- Those Killer Guys, located in Seaside, was issued a $2,280 civil penalty for providing pest control service without a commercial pesticide operator's license and for employing multiple unlicensed pesticide applicators. Rick Kazemba and David Darling, both of Seaside, were each issued a $380 civil penalty for their roles in the incidents.
- Wilbur Ellis Company, a licensed commercial pesticide dealer headquartered in San Francisco but with an operation in Shedd, was issued a $592 civil penalty for selling a restricted use pesticide to an unlicensed individual.
- Fly Guard Systems, Inc., a licensed commercial pesticide operator located in Lebanon, was issued a $440 civil penalty for using an unlicensed pesticide applicator. Duane Stevens of Lebanon was also issued a $220 civil penalty for his role in the incident.
- Solitude Landscaping, LLC, a licensed commercial pesticide operator located in McMinnville, was issued a $407 civil penalty for using an unlicensed pesticide applicator. Dennis Walker of Amity was also issued a $407 civil penalty for his role in the incident.
- Stutzman Services, Inc. a licensed commercial pesticide operator located in Albany, was issued a $407 civil penalty for using an unlicensed pesticide applicator.
Individuals receiving civil penalties from the Oregon Department of Agriculture can contest the notice through an administrative hearing.
