Intrastate Household Goods Transportation

The proposed changes are to clarify the scope and intent of Division 60 rules and reflect current practices of household goods regulation.

These proposals are no longer open for public comment. The Oregon Transportation Commission will consider approval of these proposed rule changes on the date shown below the rule description.

Maximum Allowed Tow Length for Mobile Homes

The proposed rule amendment follows suit with Oregon’s neighbors -- Nevada, California, Idaho and Washington -- to extend the maximum length of a towed mobile home from 75 feet to 80 feet which will promote the efficienct movement of manufactured buildings. The amendments also provide the Administrator of MCTD with the same authority granted the Chief Engineer regarding oversight of the movement of oversized loads or vehicles.

Change in Fee Basis

As it relates to payment of weight-mile tax, this new rule clarified a long-standing procedure describing when a fee basis has changed. A fee basis is the method a carrier elects to tuse to report and pay Highway Use Tax. A carrier's fee basis eligibility is determined by the declared weight and configuration of the vehicle and commodity to be transported. The new rule defines when a change of fee basis has occurred.

Adoption of Federal Safety and Hazardous Materials Transportation Regulations

These rules contain the annual adoption of federal motor carrier safety and hazardous materials transportation regulations, and cover the adoption of international standards related to driver, vehicle and hazardous materials out-of-service violations.

Regulation of Household Goods Transportation (Temporary rule)

These temporary rules limit the amount of transit time a mover can charge for, by using a mileage software program to determine the travel time. In addition, all movers will be required to provide an estimate in writing when requested by a shipper.

Annual Readoption of IRP, IFTA and HVUT

Repeal of Bus Length Rule

This repeal was necessary to resolve a conflict between ORS 818.080 Table I (3) and ODOT's administrative rule.

These rules create a Trusted Carrier Program for passenger-carrying motor carriers similar to the program for property-carrying motor carriers.

 Motor Carrier Accounts

The proposed new rules define the meaning of a temporary motor carrier account, an established motor carrier account and a motor carrier’s legal entity, while the amended rule establishes cash deposit and security bond requirements for motor carriers that operate on temporary accounts.

Motor Carrier Registration Refunds and Transfer of Fees

These rule amendments provide definitions that explain when the Department will allow unused registration fees to be refunded or transferred to a like vehicle in the registrant’s fleet. In addition, the amendments specify the conditions for granting credit or not.
