 Adoption of International Registration Plan Regulations
These amendments include adoption of the rules of the International Registration Plan (IRP) to the date of January 1, 2012 and modify the method penalties, late payment and interest is calculated in an IRP audit.

Recently Adopted Motor Carrier Rules
These rules have been adopted by ODOT approximately within the last six months.

 

 MCSAP Motor Carrier Safety
Amendment of intrastate exceptions to federal motor carrier safety transportation regulations. Permanent rules were originally filed on October 26, 2011with the Secretary of State, but the amendments were inadvertently omitted during the annual re-adoption filed in February 2012. This is a new filing to correct the omission.

 Prohibited Use of Trailers
This amendment clarifies the prohibition from using a passenger-carrying commercial motor vehicle (bus or van) to transport passengers in a trailing vehicle, while allowing the use of passenger-carrying CMVs in combination with certain trailers to transport passengers in the CMV and transport equipment or supplies in or on a trailer.

 General Penalties
ODOT assesses general penalties for violations of statutes and rules related to motor carrier safety and progressive levels of penalties based on the motor carrier’s compliance history.  A carrier that repeats similar violations is subject to a suspension of operating authority in addition to any monetary penalties. The amendment adds provisions related drug and alcohol testing or use to the classifications for which "similar violations" are determined.

 Annual Readoption of FMCSR and HazMat Regulations
These amendments cover the annual adoption of federal motor carrier safety and hazardous materials transportation regulations and the adoption of international standards related to driver, vehicle and hazardous materials out-of-service violations.

 Annual Readoption of IFTA and HVUT
These amendments readopt Title 26 CFR Part 41 (HVUT) and International Fuel Tax Agreement (IFTA), effective January 1, 2012, to ensure Oregon remains current with national commercial motor vehicle registration standards and international IFTA standards.

 Authority to Impose Travel Restrictions (Permanent)
This rule delegates authority to the Motor Carrier Transportation Division Administrator to impose restrictions on travel involving over-dimension loads or vehicles to protect the public or state infrastructure.

Division 75 changes relate to transportation of mobile homes and modular building units; Division 76 changes relate to the issuance of permits allowing tow vehicles to tow oversize disabled vehicles on state highways

 Legibility of Highway Use Tax Reports
The amendment establishes the standard criteria for which highway use tax reports submitted to the Department will be accepted as legible and readable.

 Maximum Fine Schedule
This amendment implements HB 2712 which establishes one presumptive fine for each class of violations and eliminates the confusing way fines have historically been calculated.
