Certification Program

ODOT Local Agency Certification Program

The Local Agency Certification Program is a federal program that enables Certified Local Public Agencies (CLPA) to obtain optimum approval authority and control at the local level when delivering federally funded transportation projects.

The program’s objectives are to reinforce and facilitate delegation of authority and responsibility at the lowest practical level, and also to build in the mechanisms for accountability and assistance to ensure top performance; to reduce the cost of doing business while maintaining quality; and to focus on the customer — the people of Oregon.

Program Mission

"Streamline the Local Public Agency (LPA) delivery process of FHWA projects by certifying highly qualified LPA's that provide quality controls which ensure FHWA delivery requirements are met. The Certified Program Office is responsible to establish policies which facilitate the delivery and oversight of projects in a cost effective, timely manner through the collaboration of ODOT, Federal Highway Administration (FHWA) and Local Public Agency (LPA) partners."

Why is ODOT involved?

The purpose of the Federal Code of Regulations - Title 23 CFR 635.105 is to implement and carry out the provisions of Federal law relating to the administration of Federal aid for highways. ODOT is responsible to ensure that expenditure of federal funds on LPA projects meets all federal and state requirements.

FHWA, through a Stewardship Agreement with ODOT, delegates authority to ODOT for approving project development and construction administration. ODOT has the option of delegating some or all of this authority to qualified local public agencies (LPAs) per 23 CFR 635.105. ODOT’s Certification Program permits an LPA to retain more of the approval authority at the local level when developing FHWA funded transportation projects. The Certification Program does not eliminate any project development requirements.

+ Local Agency Specifications Section 100 General Conditions

This document is essentially the 2015 edition of the Oregon Standard Specifications for Construction, and includes many of the current ODOT boilerplate special provisions. These Specifications have been modified by a committee of ODOT and APWA members to provide a template as a starting point for Certified Local Public Agencies (LPAs).

The certified LPA needs to download (select OPEN) the word version and modify this template in track changes to establish their agency’s proposed general conditions for all their FHWA certified projects and submit it to ODOT’s Certification office at ODOTcertification@odot.state.or.us for our processing and DOJ review of the tracked changes. This requirement, along with agency specific requirements to amendments, is in your Master Agreement IGA.

If a Certified LPA decides to modify the materials QA program,Section 2 of the MFTP, then the "LPA Quality Assurance Program" template needs to be submitted to ODOT for review and concurrence along with the "General Conditions for Construction for (Certified LPA)"
