Questions and Answers
Teaming Restrictions

The teaming restrictions for the Willamette River Bridge procurement are:  
 
(1)  No Entity (or Affiliate of the Entity) which has been selected for the short-list on the Architecture & Engineering (A&E) solicitation will be allowed to propose as any part of the team for the Construction Manager/General Contractor (CM/GC) solicitation;
(2)  A firm that is not a Subcontractor on the short-listed team for the A&E solicitation will be eligible to participate as a Subcontractor on the teams Construction CM/GC soliciation; and
(3)  Firms may form a joint venture or partnership to propose on this Project.  
 
Given these restriction criteria, if the Subcontractor you are proposing to use is not on one of the short-listed A&E teams, then it is acceptable for your team to include them. However, if the Subcontractor is on one of the short-listed A&E teams, you may not use them in the CM/GC solicitation until after the A&E process is finalized, which will be May 1, 2008; which unfortunately will be well after the anticipated CM/GC Proposal due date of March 7, 2008.
 
The Subcontractor / Sub-consultant Restrictions after Contract award will be:  
 
(1)  A Subcontractor or Sub-consultant may participate on both the A&E and CM/GC teams only if the Work they are performing does not exceed:
  • $1.5 million dollars on the A&E Contract, or
  • $20 million dollars on the CM/GC Contract
 
All of the teaming restrictions will be listed in the final CM/GC RFP, Instructions to Proposers, Sections 1.1.2 and 1.1.3.  The final RFP is scheduled for release on Friday, January 25, 2008.  
 
 
 

Questions and Answers
 
**NEW**  1)  I would like to know if a foreign company, who has a construction license in the US, can participate in the project as a general contractor.
 
Answer: According to the Oregon Revised Statutes ORS 60.701, a foreign corporation must be registed by the State of Oregon, Office of Secretary of State, before conducting business in the State of Oregon. A foreign corporation (ORS 60.001) means a corporation-for-profit incorporated under a law other than the law of the State of Oregon. All firms that are part of a Proposer's team must be registered by the State of Oregon.
 
Also, the successful proposer must be registered with the Oregon Construction Contractors Board  (http://www.oregon.gov/CCB) prior to execution of a construction contract. 
 
 
2) Question: Will Bundle 220/Willamette River Bridge (Lane County) will have a PI recruitment in it for PI subcontractors to bid on?
 
Answer: While there is a public involvement element included in the current Summary of A&E's Scope of Work of the Request for Qualifications (RFQ) for Willamette River Bridge Project, ODOT has decided to hold closely the PI effort for the project, relying on our existing contract with OBDP to provide support to agency in executing the PI effort. ODOT anticipates OBDP will use their existing PI subconsultant for the Program and therefore do NOT expect any subsequent opportunity for bid. ODOT's intention for the A&E's PI participation for the project is limited to activities deemed appropriate to the A&E discipline/skill set as determined by the agency's Willamette River Bridge project team. The scope of A&E's activities are more clearly articulated in the RFQ (in Attachment A "Summary Scope of Work for A&E" Subsection "Public Involvement") that will be issued 9/25/07.
 
3) When is the RFQ For Willamette River Bridge (Lane County) going to be issued and when/where is the MANDATORY pre-submittal conference?
 
Answer:  ODOT plans to issue the Willamette River Bridge (Lane County) A&E RFQ on Sept. 25, 2007 and to hold the mandatory pre-submittal conference for the A&E RFQ October 2, 2007 10:30 a.m. at the Veterans Auditorium, 700 Summer Street NE, Salem, OR.

Please pay strict attention to the Oregon Procurement Network Information (ORPIN) postings as that is the official informational posting site that will include any changes to the anticipated schedule. Be mindful that nothing stated via email or phone during this pre-solicitation period is binding on the state.

4) Question: I was wondering when we can expect to see the "conceptual design", and also is September 24 still the day the SOQ for the Willamette River Bridge will be released?

Answer: The design developed as part of the Environmental Assessment work (i.e., "conceptual design") will be posted as part of the data that will be on the official (OBDP) web site as soon as it is operational. The current schedule shows the RFQ release date of 9/25/07.
 
5) Question: I attended the A-E forum for the I-5 Willamette River Project, where it was stated that the sign in sheet for the forum would be posted on the internet. Would it be possible to get a pdf of the sign in sheet or a link of where it is located?

6) Question: Are there any DBE requirements for this project?
 
Answer:  Agency will be using 15% Aspirational Targets for DMWESB's on the Willamette River Bridge (Lane County) project for the A&E Final Design portion of the work. Since the CM/GC portion of the Willamette River Bridge project does contain federal funds, there will be a mandated DBE Goal of 0% which is different than MWESB. The DMWESB Aspirational Target will apply to both the A&E and CM/GC Contracts, but it is non-enforceable (just a "target"). The DBE and OJT Goals are both federally mandated, to which the CM/GC must comply.
 
7) Question: Will there be a minimum percentage that the Prime A/E must self perform?
 
Answer: Currently, ODOT expects the Prime A/E firm to be required to perform 51% of the work.
 
8) Question: Is there a MSWESB goal or a minimum requirement for the project (A/E team)?
 
Answer: A DMWESB aspirational target of 15% is planned.
 
9) Question: Is the TS&L effort included in the project and what shape . . . . is it a "wide open" TS&L, a recommendation coming from the EA, or a finite study?
 
Answer: The TS&L is not "wide open."  The Environmental Assessment (EA) will place limits on the bridge design.  The "environmental footprint" of the bridge will be defined to a degree that allows determination of the environmental impact of the bridge.  At this point in the environmental process, it appears that the definition of that footprint will consist primarily of horizontal and vertical alignments, a limitation on the number of piers located below ordinary high water (OHW), and some additional limitations on the location of those piers.  The current state of that definition is two separate bridges, one for northbound and one for southbound, each 68 feet wide with three piers below OHW for each bridge.
 
The EA will also include goals and objectives for the project developed by the Project Development Team (PDT) as advised by the Community Advisory Group (CAG).
 
ODOT anticipates that the type of bridge will not fixed by the EA.  The PDT and CAG have been considering several types of bridges which appear to fit within the budget and the environmental footprint constraints.  The PDT and CAG will continue with the project through the design phase and will advise the design team.
 
10) Question: Given that the ORPIN notice states that any firm participating as a subcontractor on the EA work is precluded from the PS&E work, it would be nice to have a list of those consultants so as we build our teams we know what firms are ineligible. Is a list available?
 
Answer: Subconsultants currently working on the EA: 1) Jeanne Lawson Associates Inc. from Portland. 2) Heritage Research Associates, Inc. from Eugene. 3) Mark J. Greenfield, a sole proprietorship from Portland."
 

11) Question:  We were inquiring if you have a firm date for the release of the RFQ on the Willamette River Bridge project.  ORPIN states August 2007, do you know if this is the start or end of August?
 
Answer: The current planned date for release of the Request for Qualifications (RFQ) for A&E Services for final design of Willamette River Bridge (Lane County) is 9/24/07.
 
12) Question: I noticed the RFP for the A/E design of the Willamette bridge has been removed from ORPIN? Could you please let me know if this is still active? If so, when it will be issued?
 
Answer:  A new notice of ODOT's intention related to the procurement of Design Services for Willamette River Bridge was posted to ORPIN 6/7/07 and Addendum #1 was posted 6/8/07. The notice indicates, among other items, that a Request for Qualifications (RFQ) for design services will be issued by ODOT's Major Projects Branch Bridge Delivery Unit in August of 2007. Please see the ORPIN posting for additional information.
 
13)  Question: I was wondering if you had any new information on the release of the RFQ for the I-5 Willamette River Bridge?"
 
Answer: ODOT is targeting a mid-August 2007 for release of the RFQ for A&E Final Design for Willamette River Bridge- Lane County.  This answer reflects ODOT Willamette River Bridge Project Team's current thinking/understanding.  Be mindful that information provided in the official procurement documents will supersede this answer.
 
14)  Question: Will the new bridge be six or eight lanes?
 
Answer: ODOT has reached an agreement with FHWA regarding the width of the bridge.  The bridge (or bridges) must be designed with 64 feet of unobstructed pavement between the bridge rail and the median barrier (or between rail and rail if two bridges are used) in each direction (both north-bound and south-bound).  The basis of this unobstructed pavement width is three 12-foot lanes, 12-foot shoulders on each side, and 2-foot shy distance on each side (for each direction: for NB and for SB).  Part of the basis of this agreement is that, should four lanes in each direction be required in the distant future, a substandard but "safe" lane and shoulder condition could be accommodated on the bridge(s).  Of course, additional bridge structure width will be required to accommodate the bridge rails and any median barrier adding approximately 2 feet of width for each rail or barrier.
 
At the end of construction, the traffic control plan must be configured to carry only two lanes of traffic crossing the bridge (to be consistent with the existing pavement configuration approaching the bridge).
 
15) Question: Will the project include improvements to Franklin Blvd?
 
Answer: No. The project will not include improvements to Franklin Blvd. but will provide for reasonable accommodation of future Franklin improvements.
 
16) Question: On the upcoming RFQ for Design Services for the Willamette River Bridge project, please let me know what the MWESB content requirements will be.
 
Answer: Since there will be no federal funds for design phase, there will be no DBE requirements.  There will be aspirational  DMWESB goals consistent with the OTIA III Statewide Bridge Delivery Program Goals.
 
17) Question: I have tried to locate the RFP for the above mentioned procurement on the ORPIN web site and have only been able to locate an amendment.  How can I obtain a copy of the complete RFP?
 
Answer:  The amendment that you mention is an addendum to an informational notice only, not a RFP.  No RFP has been posted as the notice on ORPIN indicates.  Brenda Jungwirth is the key point of contact for the Willamette River Bridge Project.  She can be reached at (503) 986-6615 or via email at brenda.jungwirth@odot.state.or.us, should you have any further questions.
 
18) Question:   Is the NEPA work being done now and if so can we track the progress on ODOT's Region 2 project website, or contact anyone with questions about the progress?
 
Answer: Yes, the NEPA work is underway.  Any information of significance to the project derived from the ongoing NEPA work will be posted to the Region 2 project website."
 
19) Question:  I am confused by the STIP data, please help.  The total cost is listed as $86,265,000 and at the bottom it is listed as $180,000,000.  Does ODOT have $180 million to construct the bridge or only $86 million?
 
Answer: The budget is as shown on the OTIA III Monthly Progress Report from OBDP.  See the attached Report Page that indicates the $180,000,000 project budget $150,850,000 is for construction.  That is for construction of the entire project, not just the bridge.
 
20)  Question: What is the current and anticipated main span length for the original bridge, the detour bridge, and the new bridge?  The slide show says "minimize the number of piers in the river," so I'm guessing that there will be two main span piers in the river with two side spans (end abutments on shore).  I need to at least know the length of the existing bridge and detour bridge spans to get an idea of the main span length required.
 
Answer: The plans for the detour bridge are on the project's ftp site (ftp://ftp.odot.state.or.us/I5-WRB ).  The plans for the existing bridges will soon be loaded to the project's ftp site.  The length and pier locations for the main span will be determined through the NEPA and project development processes.
 
21) Question: What are the general soil conditions at the site?  Looking at the photo of the existing bridge, it appears that there are a number of rocks/boulders in the river at the bridge location, which would indicate a "glacial till" type of soil at the bridge site.  Could you confirm this?
 
Answer: Please refer to the Geology Report on the project's ftp site (ftp://ftp.odot.state.or.us/I5-WRB) for answers to this questions.
 
22) Question:  What will the bridge design criteria be for seismic (Effective Peak Acceleration or reference to ODOT bridge manual requirements).
 
Answer:  Seismic design criteria to be used will be in accordance with the most current version of the Bridge Design and Drafting Manual which is available at this web site: http://www.oregon.gov/ODOT/HWY/BRIDGE/standards_manuals.shtml.
 
23) Question:   Can we use the same Public Involvement firm in our proposal for the Willamette River Bridge Project RFQ/RFP as HDR is using to complete the NEPA document for the project?
 
Answer: Please see the administrative correction made by the attached addendum to ODOT's
original  Willamette River Bridge project's informational notice clarifying ODOT's position on non-eligibility (if subcontracted with OBDP during the NEPA phase of work) for participation as a prime or a subconsultant for Agency's planned solicitation for Willamette River Bridge project's final design.
