Article Content - Direct Appeal Criminal Cases: These cases include appeals from: jury, bench, and stipulated-facts trials; conditional-plea hearings; state's appeals; guilty and no-contest pleas; probation-violation and resentencing hearings; and contempt proceedings. Using the information included on this form, the Office of Public Defense Services will prepare and file the Notice of Appeal in direct appeal criminal cases. Important: Except in state's appeals, do not refer a case until after the defendant has been sentenced.
- Juvenile Dependency Appeals: Use this online form for direct appeals in juvenile dependency court cases. Please review the form instructions. NOTE: OPDS will not accept a referral for an appeal from a judgment that the juvenile court has not yet entered in the OECI trial court register.
- Juvenile Delinquency Appeals: Use this online form for direct appeals in juvenile delinquency court cases. Please review the form instructions.
- Parole Appeals. Refer parole appeals by U.S. Mail, telephone, or fax, to the address or telephone number on the right.
- Immigration Referral: Use this form when seeking a legal consultation regarding possible immigration consequences to non-citizen clients. Information submitted on this referral form is confidential. OPDS will not disclose referral information except as necessary to make it available to the Immigrant Rights Project. This service is available to court-appointed counsel to aid them in satisfying their obligations as established in Padilla v. Kentucky.
