Foam Encapsulation
Foam Encapsulation Certification Instructions
An Encapsulation Certification Form is required for all new construction projects or additions to existing structures involving polystyrene foam floatation, and certain other maintenance, alteration and repair projects as specified in the rules. These rules apply to allpublic and private floating structures placed on the waters of this state.
 
"Polystyrene Foam Floatation" -- means all products manufactured from expanded polystyrene foam beads with cell diameters of 0.125" or larger used as floatation.
 
Any polystyrene foam device manufactured into extruded closed cell beads 0.125 inch or smaller, approved for marine use, is exempt.
 
All polystyrene foam private or public buoys, markers, ski floats, bumpers, fish trap markers or similar devices must be encapsulated in accordance with the New Construction OAR 250-014-0030, but an Encapsulation Certification Form is not required for these items.

FORM COMPLETION INSTRUCTIONS
1. Determine if a Certification Form is required
Determine if a Certification Form is required for your project under Oregon's Floatation Encapsulation Rules, OAR 250-14-0010 thru -0090. In general ,all new construction, repairs or maintenance requiring the replacement of more than 10% in square footage of floating structure, or any alteration or addition of an existing floating structure which leads to an increase in the square footage of the floating structure requires certification that the foam is encapsulated with an approved method. See below for an excerpt of OAR 250-0140-0030 which lists approved materials or methods of encapsulation.

2. Complete the Encapsulated Foam Certification form
Complete the ONLINE Encapsulated Foam Certification Form or fill out the Encapsulated Foam Application Form (in PDF format or in Word format ) and mail it to the Clean Marina Coordinator, Oregon State Marine Board, PO Box 14145, Salem, OR 97309-5065.
A. The Certification Form may be completed and signed by the owner, an authorized agent, ora contractor.
 
B. In Section 2 of the Form, enter the location of property where the project is to take place. Information on the waterway description may be obtained from a topographic map or boating chart.
 
C. You may check more than one box in Section 3 for the Project Type. If more than one box applies, specify the number of floating structures for each proposed project.
 
D. You may check more than one box in Section 5 on Material and Methods of Encapsulation. Give the thickness of the encapsulated material, product name, and estimate the amount of foam to be used for each proposed project in cubic feet and/or number of billets.

3. There are no fees associated with the Certification Form.
Please allow 10 working days for review and approval.
 
Remember, an approved Certification Form does not relieve the applicant from obtaining other federal, state, or local permits, licenses, or approvals which may be required.

(5) The following materials or methods of encapsulation are approved:
(a) Treated dimensional wood, 1.5 inches (actual) or more in thickness. Non-Treated dimensional wood 4.0 inches or more in thickness and round wood logs are permitted.
 
(b) Treated plywood 0.5 inches or more in thickness. Non-Treated marine grade plywood 0.5 inches or more in thickness is permitted.
 
(c) Concrete 1.0 inch or more in thickness.
 
(d) Galvanized steel 0.065 inch or 16 gauge or more in thickness.
 
(e) Liquid coatings, 30 mils or more in thickness, chemically or securely bonded.
 
(f) Rigid (hard) plastics, 50 mils or more in thickness.
 
(g) Fiberglass and plastic resins, 30 mils or more in thickness, chemically or securely bonded.
 
(h) Pliable (soft) plastic sheets, 7 mils or more in thickness, chemically or securely bonded. Multiple layers of single plastic sheets less than 7 mils in thickness are notpermitted. The process of using shrink wrap is permitted.
(6) All fuel floats or floating structures used to store, maintain or repair boat engines shall be encapsulated with materials that are not subject to degradation by fuel oils or products.
