Marine Board Opens Rulemaking Process and Approves Rule Clarification
For Immediate Release -10/28/11
The Oregon State Marine Board approved initiating the rulemaking process pertaining to the Aquatic Invasive Species Permit Program.  The Board also approved rules for Boating Under the Influence of Intoxicants at their quarterly Board meeting held on October 26 in Eugene.
The intention of the aquatic invasive species rulemaking is to amend OAR 250-010-0650 to clarify the permit presentation requirements and remove statutory violation language and to adopt OAR 250-010-0660 for inspections of recreational and commercial boats for the presence of aquatic invasive species at inspection stations.  The Oregon Legislature approved mandatory boat inspections during the 2011 session, and directed the Marine Board to implement this law through administrative rule.  Both aquatic invasive species administrative rules will be open for public comment beginning December 1.  The Board will vote at their next meeting in January 2012 to adopt the aquatic invasive species rules.
The Board also approved modifying and consolidating current BUII language in Marine Board administrative rules OAR 250-010-0430 and 250-010-0440 related to breath testing and the repeal of OAR 250-010-0400, 250-010-0450 and 250-010-0460.
