A Nyssa-area man arrested Sunday afternoon on Manslaughter and DUII charges following a single vehicle fatal traffic crash has been postively identified as DAVID RAIGOZA FRANCO, age 34, from Nyssa.
The crash resulted in the death of his daughter on Highway 201 about one mile south of Nyssa. Oregon State Police, working in conjunction with the Malheur County District Attorney Office, are continuing the investigation. An Oregon State Police collision reconstructionist confirmed that neither occupant was using safety restraints.
On July 22, 2007 at approximately 3:15 p.m. a 2000 Cadillac Escalade driven by FRANCO was southbound on Highway 201 near milepost 1 entering a left hand curve when it lost control and rolled. The vehicle came to rest on its wheels in the middle of the highway.
The driver's daughter identified as CLARISSA VASQUEZ CALDERA, age 8, was ejected from the vehicle and pronounced deceased at the scene.
The driver was initially identified as DANIEL CABELLO DELEON, age 31, reportedly from Nyssa. He was positively identifed as FRANCO through fingerprints and had outstanding warrants for his arrest. According to Malheur County Correctional Facility, FRANCO is held for Manslaughter in the Second Degree, Criminally Negilgent Homicide, DUII, and warrants for Probation Violation (2 counts), Resisting Arrest, and Furnishing False Information to a Police Officer.
Oregon State Police (OSP) troopers from the Ontario Area Command office, with the assistance of an OSP collision reconstructionist and the Malheur County District Attorney, are continuing the investigation.
