A 3-year old child in a stroller was killed Tuesday afternoon when she was struck by a vehicle while being pushed across an intersection on SE 82nd Avenue at Boyer Road. No enforcement action has been taken as the investigation continues.
On December 5, 2006 at about 1:30 p.m., the Oregon State Police received a call of a car striking a pedestrian on SE 82nd Avenue (State Route 213) at Boyer Road. Responding troopers and emergency personnel found that a 3 year old girl was struck in her stroller as she was crossing 82nd Avenue with her mother and sister. Preliminary investigation indicated that at the time of the crash the 3 year old victim was being pushed by her mother who was not struck. The victim's 5-year old sister was also struck and seriously injured.
The victim was identified as MIRIANA LUIS GARCIA, age 3. Her 5-year old sister, YOLIANA BELEN LUIS GARCIA, was transported by AMR ambulance to Legacy Emanuel Hospital with serious, non life-threatening injuries. Their mother, SUSANNA LUIS, from southeast Portland, was not injured.
The vehicle's driver, DARRELL D. BEFFERT, age 54, from Clackamas, was uninjured and is cooperating with troopers as part of the investigation.
The investigation is ongoing and will be forwarded to the Clackamas County District Attorney's Office who sent a representative to the scene of the crash. OSP troopers from the Portland Area Command office, assisted by members of the interagency Clackamas County CRAFT team, are conducting the investigation.
