What's New in Oregon Sex Offender Registration

The 2007 Legislative Session brings the following changes to Sex Offender registration effective January 1, 2008:

 
House Bill 2333 – Provides relief from sex offender registration for certain sex crime convictions  
Who qualifies?
 
            Anyone currently registering for certain crimes if:
  1. The act was consensual between the victim and the offender but due to the victim being under 18 years of age, the offender was found guilty; and
  2. The victim was 14 years of age or older at the time of the crime; and
  3. The offender was less than 5 years older than the victim at the time of the crime; and
  4. This is the offender’s only sex crime conviction or adjudication.
 
Anyone convicted in adult court or adjudicated in juvenile court of certain crimes after January 1, 2008, if the court determines the above circumstances exist and the sentencing order states the offender is not required to register as a sex offender.
 
What crimes qualify?
            Rape in the third degree
            Sodomy in the third degree
            Sexual Abuse in the third degree
            Contributing to the Sexual Delinquency of a Minor
            Sexual Misconduct
 
How do I get this relief if I’m currently registering?
Persons who feel they meet the above qualifiers can download the court form from the Oregon State Police, Sex Offender Registration Unit website (see Relief, House Bill 2333 ).  An instruction page and worksheet is also available. 
 
Persons will submit the original form to the court where the adult conviction or juvenile adjudication took place and send a copy to the district attorney’s office in that county. 
 
Persons convicted in adult court or adjudicated in juvenile court in another state will submit the original form to the court in the county where they reside and send a copy to the district attorney’s office in that same county.

How do I get off the Oregon Sex Offender Registry?
If relief is granted by the court, a court certified copy of the relief from registration order must be mailed to the Oregon State Police, Sex Offender Registration Unit.  Unless the order is received, you will not be removed from the registry.
