Appeal Process on Strunk/Eugene Overpayments
As a first step in recovering the amounts overpaid to individual recipients from the 1999 Tier One regular account earnings overcrediting, the PERS Board adopted a final order on recovery methods. Recipients of those overpayments were mailed a copy of that order along with a letter explaining their rights to appeal the matters contained in that order. An appeal must be made within 60 days of the date the letter and Board order were mailed (March 9, 2006). Those appeals must be filed in the Marion County Circuit Court or a circuit court in Oregon where the recipient resides. Any such appeal would be limited to challenging the Board's determination of the methods that will be used to collect the overpayments.
 
Each person whose benefit must be adjusted because of the 1999 Tier One regular account earnings recrediting from 20% to 11.33% will receive an individual explanation of the affect of that adjustment. Those explanations will be sent over the next three years as the adjustment calculations are completed. A general timeline to complete the adjustment calculations is posted. The appropriate method to challenge the calculation of the adjustments will be set out in the explaination that will be sent to each affected person.
