A. Action item - Review of draft minutes from Oct. 16-17, 2013, EQC meeting
The commission will review and take action on recent meeting minutes.

B. Informational item: Budget and legislative updates
DEQ staff will present updates about the federal, state and agency budget development process and any legislative information from recent Oregon Legislature organizing days.

C. Action item: Certification of DEQ’s budget
The commission must certify DEQ’s budget submittals. DEQ staff will present an overview of the 2013-15 DEQ Legislatively Approved Budget and request that the commission chair certify the budget.

D. Action item: Updates to Division 11 and 12 rules
DEQ staff will present proposed updates to Division 11 and 12 rules, which govern some of DEQ’s administrative processes related to enforcement and compliance.

E. Informational item: Developing environmental solutions
DEQ staff will present an overview of the agency’s new process to plan, prioritize and implement solutions to environmental problems.

Lunch and executive session
Commissioners, legal counsel and some DEQ staff will meet for a working lunch and executive session from approximately 11:15 a.m. to 12:30 p.m. The session will be held pursuant to ORS 192.660(2) (h).

G. Action item: Temporary rules for Clean Fuels program
DEQ staff will present temporary proposed rules for the Oregon Clean Fuels Program. The proposed rules would simplify recordkeeping requirements for many fuel suppliers and sources in Oregon. The commission will offer a public comment period specific to the proposed temporary rules as part of this item. People wishing to present comment on the proposed rules are asked to complete a registration form available at the meeting and limit their comments to no more than three minutes. Comments will be taken in the order the registration sheets are submitted, and the commission may shorten or extend the time allotted for this item at its discretion.

H. Informational item: Updates to Oregon’s Smoke Management Plan
DEQ staff will present information about proposed updates to the Oregon Smoke Management Plan. The Oregon Department of Forestry manages prescribed burning under the Oregon Smoke Management Plan. Changes to the plan require both Oregon Board of Forestry approval and EQC approval as a revision to the Oregon State Implementation Plan. DEQ is seeking feedback from the commission on the proposed changes prior to moving ahead with rulemaking in 2014.
 
I. Action item: Transportation Control Measure Rules
DEQ staff will present proposed rules to update the transportation control measure for the Portland metropolitan area. The measure is part of the Portland Area Carbon Monoxide Maintenance Plan and requires transit service in the Portland area to be expanded one percent per year. The proposed changes would revise the way the measure is calculated.

J. Informational item: Hermiston Foods and odor concerns
DEQ will present information about its work regarding Hermiston Foods, a food processing plant in Hermiston. Neighbors of the plant have raised concerns about the plant’s effects on human health and the environment, and the commission requested an informational update in late 2013.

K. Informational item: Commissioner reports
Commissioners will present verbal updates on their activities and projects of interest and relevancy to the commission.
 
 
The commission will recess its regular meeting at approximately 5 p.m. until 8:30 a.m. on Thursday, December 12. Commissioners and some DEQ staff may attend an informal, optional and self-pay dinner on Wednesday evening. No commission business will be held during dinner.

L. Public forum
At 8:30 a.m., the commission will open public forum. This item is scheduled for 45 minutes, but time allotted may be extended or shortened at the commission’s discretion. People may present comment in-person or remotely by teleconference call at one of several DEQ offices across the state. No comments may be presented on DEQ rulemakings for which the public comment period has closed. All people wishing to comment must complete request-to-speak forms and the commission may limit times based on the number of people wishing to comment.

People wishing to present comment by telephone may do so at the Eugene, Medford, or Pendleton DEQ offices:

M. Informational item: Oregon’s groundwater
DEQ staff will present an overview of groundwater quality issues and protection activities in Oregon. This item is presented as informational background to help EQC in prioritization of challenging environmental issues facing the state.

N. Informational item: Water quality monitoring summit
DEQ staff will share the results of a recent water quality monitoring summit and describe the agency’s work to build professional networks to share information among state, federal, local and tribal governments and environmental organizations in Oregon.

O. Action item: Onsite program rules
DEQ staff will present proposed rules to update the Onsite Septic System Program. The proposed rules would increase some program fees, clarify program language and make other adjustments.

P. Action item: Low- and zero-emission vehicle rules
DEQ staff will present proposed rules to update the Low and Zero Emission Vehicles Program. The proposed rules would update Oregon’s existing Low and Zero Emission Vehicle Program rules to match revisions adopted by California in 2012. Oregon has opted-in to California’s emission standards. Under the federal Clean Air Act, states that choose to apply emission limits that are more stringent than federal standards for new vehicles must adopt California’s vehicle emission standards.

Q. Action item: Water quality toxics criteria revisions
DEQ staff will present proposed rules to update the Water Quality Division toxics standards. The proposed revisions will correct and clarify the standards, previously adopted by the commission in 2011. Revisions to water quality standards require EPA approval before revisions become effective for Clean Water Act programs.

Director Pedersen will present updates on DEQ activities and projects of interest to the commission.

S. Informational item: Organizational structure updates
Director Pedersen will discuss organizational structure changes at DEQ, made in late 2013 and to be implemented Feb. 1, 2014, in alignment with the agency’s outcome-based management system.
