Senate Bill 263 (2015) made fundamental changes to the Opportunity to Recycle Act (ORS 459A). SB 263 revised material recovery and waste prevention goals and requirements for Oregon's municipalities and wastesheds.
 
DEQ is implementing SB 263 and the framework that is described in Materials Management in Oregon: 2050 Vision and Framework by adopting administrative rule amendments.
 
The adopted rule changes include:
 
  • Amending wasteshed recovery goals for individual wastesheds and removing administrative compliance burdens associated with these goals.
  • Amending the state's recovery goal and adding statewide recovery goals for three high-impact materials: food, carpet, and plastics.
  • Adding four more recycling program elements. This will allow cities greater choice and flexibility in implementing local recycling programs. The new elements will increase to 13 the recycling program options available to cities.
  • Requiring some cities to implement additional recycling program elements based on their populations and distances from Portland.
  • Requiring cities to assess contamination levels in curbside recycling and to make plans and outreach programs to reduce contamination.
  • Retiring voluntary waste prevention and reuse programs for wastesheds (former "two percent credit programs") and enacting required "Waste Prevention and Reuse" programs for cities, based on their populations.
