Wednesday, April 20, 10:30 a.m. to 4 p.m.; evening session 6 to 7:30 p.m.

 The commission will convene at approximately 10:30 a.m.
 
  

A. Action item: Meeting minutes
Commissioners will take action on the proposed draft minutes from recent regular and special EQC meetings.


B. Information item: Welcoming Interim Director Pete Shepherd
Pete Shepherd will begin his appointment as Interim DEQ Director on April 20, as directed by the commission.

C. Action item: Proposed permanent rules for asbestos program updates
DEQ staff will present proposed rule revisions to the agency’s asbestos program. These proposed rules are an update of temporary rules approved by the commission in December 2015.


D. Informational item: Budget and legislative updates  |  Handouts
DEQ staff will present updates on agency, state and federal budget and legislative matters of interest to the commission, including the start of the 2016 Oregon Legislative Session.

Working lunch and executive session
The commission will recess from approximately 12:30 to 2 p.m. for an executive session. The session will be held in accordance with Oregon’s public meeting laws.

E. Action item: Petition for Outstanding Resource Water designation, North Fork Smith River
DEQ staff will present information regarding a request to designate the North Fork of the Smith River as an Outstanding Resource Water. The petitioner and other related entities may present additional information for commission consideration as part of this item.


F. Informational item: Commissioner reports and agenda planning
Commissioners will present written and verbal updates on their recent activities and other items of interest to the commission.

 
G. Informational item: Director’s report
Interim Director Shepherd will present written and verbal updates on items of interest to the commission.
 
The commission will recess from approximately 4 to 6 p.m.
 
Evening public comment session 

H. Public comment: Draft criteria for recruitment of DEQ’s permanent director
At 6 p.m., the commission will open a public comment opportunity specific to proposed draft criteria and processes for the recruitment of DEQ’s permanent director. People who wish to present comment are asked to complete a short registration form, available at the meeting.
 

The commission will recess at approximately 7:30 p.m.

I. Action item: Proposed temporary rules for air toxics  |  Addendum
DEQ staff will present proposed temporary rules regarding air quality emissions from facilities within the Portland Air Quality Maintenance Area that manufacture colored glass for use in art, architecture, interior design and other similar decorative applications, or that manufacture glass products for use by manufacturers of colored glass for use in art, architecture, interior design and other similar decorative applications.

J. Informational item: Air Quality Program overview
DEQ staff will present an overview of the agency’s Air Quality Program, as recently requested by the commissioners.
 
K. Informational item: Engagement plan and process for developing permanent air toxics rules
DEQ staff will present a draft plan and timeline for development of permanent air toxics rules, including planned community engagement and other outreach efforts.


L. Public comment: Engagement plan and process for developing permanent air toxics rules
At approximately 11:15 a.m., the commission will open a 60-minute public comment opportunity specific to the items discussed on Thursday morning. People who wish to present comment are asked to complete a short registration form, available at the meeting.

 
Lunch
The commission will recess for lunch from approximately 12:15 to 1:15 p.m.


M. Public comment: General
At approximately 1:15 p.m., the commission will open a 60-minute public comment opportunity. People who wish to present comment are asked to complete a short registration form, available at the meeting, and are asked to limit comments to five minutes or less. No comments may be presented on a proposed rule adoption for which a comment period has been held and closed.


N. Action item: Proposed temporary rule revisions for the Oregon Clean Fuels Program
DEQ staff will present proposed temporary rule revisions for specific technical corrections within the existing Oregon Clean Fuels Program calculations.

 

O. Action item: Criteria and process for permanent director recruitment
DEQ and Department of Administrative Services staff will present proposed final criteria, requirements and processes for the recruitment and hiring of a permanent DEQ director. The commission will review and take action on these proposals, and otherwise direct DEQ and DAS in the next steps for the recruitment and hiring process.
