A 60-day expedited General Permit (GP) is now available for certain projects impacting vernal pool wetlands in Jackson County. The GP rules (OAR 141-093-0180 et seq.), effective April 1, 2012, describe mitigation standards consistent with those established for the federal Endangered Species Act and Clean Water Act.
The vernal pool GP is for applicants who choose to use the programmatic biological opinion developed by the US Fish and Wildlife Service, which administers the ESA. The CWA is administered by the US Army Corps of Engineers. The conventional removal-fill permit process is still available for those who do not qualify or want to use the new GP.
