Purchasing Mitigation Credits
How and when to buy credits:
Permit applicants who wish to purchase mitigation bank credits or in-lieu fee (ILF) program credits rather than conducting their own mitigation should follow these steps:
Step 1: Identify if there are banks or ILF projects that serve the location of your project by using the combined service area map or individual bank and ILF service area maps
Step 2: Next, match the HGM and Cowardin classification of the wetlands to be lost at the project site with the HGM and Cowardin classes provided at the bank and ILF project sites. Note that credits from an ILF project may only be used if there are no matching credits available from a bank.
Step 3: Contact each banker or ILF sponsor to discuss credit availability and terms of sale, including expected number of credits needed and the timing of purchase. Identify the selected bank or ILF project in the permit application, but do not complete the credit purchase yet. Credits from DSL's In-Lieu Fee Projects may be reserved by completing an Oregon In-Lieu Fee Credit Reservation Form.
Step 4: Completion of the credit purchase takes place just before the permit is issued. The DSL Resource Coordinator and Corps Project Manager will inform the applicant of their approval to use a particular bank or ILF project and the number of credits required.
For DSL, a copy of the proof of purchase must be provided before the permit will be issued. For the Corps, credit purchase must be completed before work begins in a water of the US. If one agency takes longer to complete the permit review than the other, the applicant may need to request an extension of the permit decision timelines.
Additional mitigation banks are needed in many areas. If you know of a site where a large acreage of wetlands might be restored, please contact  Dana Hicks, DSL mitigation specialist, for further information about the steps needed to establish a new mitigation bank.
In areas not adequately serviced by private mitigation banks, DSL may establish an ILF project. If you know of a site where wetlands might be restored, please contact Dana FieldDSL mitigation specialist, for further information about the wetland grant program.
