Rule Caption: Amending and repealing public records request rules.

The Oregon Department of Energy (ODOE) filed permanent rules for public records requests on May 24, 2017. The permanent rules amend and repeal ODOE’s public records request rules to align our public records request rules with Oregon's Department of Administrative Services (DAS) policy, by removing duplicative language covered by the DAS policy relating to fees. The amendments also update requirements; add a requirement for a requester to provide an email address; and repeal the department’s rule on charges for computer information requests, which is covered under the general public records request rule and does not need a separate rule.

The Oregon Department of Energy will hold a public hearing on May 22 to receive comments on draft rules amending and repealing ODOE’s public records request rules.

Public Hearing Materials:

The draft changes to rule were prompted by Governor Brown’s Executive Order No. 16-06 and DAS Statewide Policy No. 107-001-030. ODOE’s proposed amendments will align our public records request rules with DAS policy, removing duplicative language covered by the DAS policy relating to fees. The proposed amendments also update requirements; add a requirement for a requester to provide an email address; and propose repealing the department’s rule on charges for computer information requests, which is covered under the general public records request rule and does not need a separate rule.

ODOE will accept oral testimony on the rules at the public hearing. Participants unable to attend may call in to provide oral comments. Written comments on the rulemaking are due by 5:00 p.m. on Monday, May 22, 2017, and may be sent via email to: elizabeth.ross@oregon.gov.  

The public hearing will be the final opportunity for comment before ODOE files permanent rules in late May. ODOE plans for the rules to be effective upon filing.
