Woody Biomass Sector of the Biomass Producer or Collector Tax Credit

The Oregon Department of Energy invites woody biomass stakeholders for the Biomass Producer or Collector Tax Credit to discuss program operations. The purpose of this meeting is to discuss written comments received from woody biomass stakeholders during the 2013 rulemaking.

During the 2013 rulemaking, the department proposed adding statutory language to rule that inadvertently created consternation among stakeholders in the woody biomass sector. This meeting is to discuss the statutory and rule language and other aspects related to the biomass tax credit program for woody biomass producers or collectors. The public hearing will be the final opportunity for comment before the department files permanent rules. ODOE plans for the proposed rules to be filed and effective at the end of February, 2016.

Biomass Tax Credit Rulemaking Advisory Committee Public Meeting

The Oregon Department of Energy invites stakeholders to participate in a discussion about application fees for the Biomass Producer or Collector Tax Credit program fee. At the meeting, ODOE will review the current fee structure and proposed fee increases.

The proposed rule for the Biomass Tax Credit program increases the application fee to $100 plus 3.8 percent of the tax credit amount for tax years beginning on or after January 1, 2016. The proposed fee increase was included in ODOE’s 2015-2017 budget approved by the Legislature. ORS 315.141(5)(b) directs ODOE to collect a fee not to exceed the cost of administering the program. Currently, ODOE collects an application fee of $100 plus 2.5 percent of the tax credit amount, which is not sufficient to cover the actual cost of program administration.
FUTURE OPPORTUNITIES TO PARTICIPATE
Following the advisory committee meeting, ODOE will review the comments and incorporate changes where needed. Stakeholders will be asked to comment on the updated draft rules at a public hearing scheduled for Feb. 22, 2016.The public hearing will be the final opportunity for public comment and input before ODOE files final rules.ODOE plans for the rules to be effective at the end of February.
RULE REVIEW
Recently ODOE completed a five-year rule review of the Biomass Tax Credit program. Aside from the proposed fee increase, ODOE does not propose further rulemaking for the program at this time.

The Oregon Department of Energy (Department) sought input on improvements to the Biomass Producer or Collector Tax Credit Certification Rules. The Department plans to begin a permanent rulemaking process in August and hosted a public information webinar to seek input and suggestions for improvements to our current rules.

During the webinar, the Department presented specific ideas for improvements to the existing rules. The Department is asking for input and suggestions from stakeholders and interested parties and presented the schedule and process for the permanent rulemaking, including the public comment period on draft rules.

The webinar was held July 26 from 8:30 AM to 10:00 AM.

Permanent Rules

Permanent rules filed for the Biomass Producer or Collector Tax Credit program

The Oregon Department of Energy filed permanent rules for the Biomass Producer or Collector Tax Credit program Friday, Dec. 20, 2013. The rule amendments and fee increases go into effect Jan. 1, 2014.

The permanent rules provide additional details about the application contents, clarify the eligibility of biomass feedstocks and activities, and increase the application fee for the tax credit program.

The Oregon Department of Energy is seeking written comments one more time on its proposed rule for the Biomass Producer or Collector Tax Credit program. The deadline for those comments is 5 p.m. on Monday, Dec. 16, 2013, email comments to kathy.d.stuttaford@state.or.us.

The department held a public hearing in October on the proposed rule. After reviewing the comments, the department edited the proposed rule. The department is reissuing the proposed rule and providing an additional written comment opportunity before finalizing the rule.
