The Oregon Department of Energy submitted final rules to the Secretary of State on December 20, 2017 relating to appliance energy efficiency standards, implementing House Bill 3025 (2017). The permanent rules filing does not include any additional changes to rule language compared to the draft rules filed on October 25. This concludes the formal rulemaking process, which closed on November 29, 2017.

The proposed rule changes are needed to align department rule with current statute as amended by Oregon Laws 2017, Chapter 295 (House Bill 3025). The 2017 legislation was adopted to change the definition of "small battery charger" in statute in order to exempt certain small battery chargers from the minimum energy efficiency standards. The affected small battery chargers are embedded within a larger product and provide functions such as maintaining information in memory caches, yet are not capable of providing power to the entire product when AC voltage is removed. The previous definition of "small battery charger" inadvertently encompassed electronic products such as computer servers and scientific instruments which could not be tested for compliance with the standard, and hence could not have been sold in Oregon after the operative date of the energy standards, causing hardship for manufacturers, retailers and the public. Other minor administrative rule changes are needed to maintain clarity and accuracy in the rules, including updating ODOE's physical and email addresses and accurately reflecting the process for adopting standards.

ODOE will accept oral testimony on the rules at the public hearing. Participants unable to attend may call in using the number listed above.

The public hearing will be the final opportunity for comment before the department files permanent rules. ODOE plans for the proposed rules to be effective on or before December 31, 2017.
