File a final offer / cost summary
Within 7 days of the date that the declaration of impasse is filed with ERB, both parties are required to submit their final offers and cost summaries of their offer to the mediator. A cost summary must be submitted on this form. For strike-prohibited units, the parties must also include a petition to initiate binding arbitration with the final offer.
After the mediator receives the final offers and cost summaries, the mediator makes them public. A 30-day “cooling off” period follows the publication of the final offer. The purpose of this time is to allow for further attempts to resolve the dispute before the parties exercise their self-help measures.
