Best Interest Determinations

Often, changes in family residence for kids in care may mean a change in the attending school. Under the Fostering Connections Act as well as Oregon Administrative Rule, the presumption is the child will remain in the current school where he/she was last enrolled, unless contrary to the child’s best interest. It is the responsibility of the Child Welfare agency to collaborate with the attending to school before bringing the recommendation to the juvenile court for a final determination.
