Oregon Household Goods Movers


Intrastate Mover Application

A certificate of authority from the Oregon Department of Transportation (ODOT) is required for persons or businesses providing, or offering to provide, for-hire transportation of household goods between two points in Oregon. "Household goods" means the personal effects or other property used or to be used in a dwelling, but does not include property transported from a store or factory or property exclusively for office use. A certificate of authority is not needed to transport household goods for-hire within certain exempt cities with a population of less than 10,000 (see ORS 825.240). Those operations require only a permit issued by ODOT. For permit information, call 503-378-6699. Regulations changed in 2009 so that now movers who want to start a new service, extend their existing service, or seek a transfer of authority must show they’re fit, willing, and able to perform the service, they’re insured and operating safe vehicles, the service will not damage highways or endanger others, and they’ll charge rates approved by the Oregon DOT. A prospective intrastate household goods mover starts the process by completing an application and submitting it to the ODOT Motor Carrier Transportation Division. Application for an Oregon Intrastate Certificate to Transport Household Goods Motor Carrier Transportation Division staff at 503-378-5985 can help determine whether a person needs a for-hire certificate, although they're not attorneys and opinions offered by staff are not binding on the Department of Transportation. To consult an attorney, applicants may contact the Oregon State Bar Lawyer Referral Service (1-800-452-7636) and ask for an attorney familiar with transportation law. To start the application process, a person must have: A business name filed with the Corporation Division. A Business Identification Number. Results of a criminal background check of all business owners. Applicant Standards An applicant must show that it is fit, willing, and able to properly provide the service sought. For the purpose of applications: "Fit" means that the applicant has not, during the five years preceding the application, been convicted of a crime punishable by imprisonment for a period of time in excess of one year under the law under which he or she was convicted, or a crime regardless of punishment involving: Theft; Burglary; Sexual conduct; Manufacture, sale or distribution of a controlled substance; Identity theft; or False statements. "Willing" means the applicant is prepared to provide all service sought in the application in compliance with ORS Chapter 825 and Department rules. "Able" means the applicant has or can provide adequate facilities, vehicles and equipment to perform the service proposed; the applicant certifies that these vehicles comply with all Oregon laws and rules covering vehicle safety and operations, and will be so maintained; and there is no significant evidence concerning the proposed service submitted by the applicant, by members of the public, or in the department’s files that suggests a compelling reason to deny the application. Examples of evidence of a compelling reason to deny an application may include a record of a pattern of violations of laws or rules administered by the Department, or two or more complaints from customers regarding applicant’s unsatisfactory resolution of loss or damage claims. Cargo Insurance An applicant must certify that it has, or will have prior to operating, Cargo Insurance or other surety of at least $10,000 to protect shippers against loss or damage to their household goods. Bodily Injury and Property Damage Insurance A person providing service only in Oregon intrastate commerce and operating vehicles or vehicle combinations that exceed 26,000 pounds must provide proof of Bodily Injury and Property Damage insurance coverage of at least $750,000. (Contact Motor Carrier Transportation Division staff at 503-378-6699 for additional requirements when operating in excess of 26,000 pounds.) For interstate operators, the insurance filing with the U.S. DOT satisfies this Oregon insurance requirements. In addition, applicants must meet other requirements related to tariffs and financial statements. Information about Tariffs Information about Financial Statements Initial Fees and Ongoing Fees Under Oregon law, ORS 825.180, applicants seeking new authority, extension of existing authority, or transfer of existing authority pay an initial, one-time $300 application fee. Under ORS 825.247, existing authorized movers pay an annual fee of $100 or .1 percent of the mover's gross revenue derived from Oregon intrastate household goods moving activity in the preceding year, whichever is greater. This $100 fee is also paid by any new intrastate household goods carrier at the time new authority is granted (see Oregon Administrative Rule 740-060-0055). Payment of the annual fee of $100 or .1 percent of the mover's gross revenue from Oregon intrastate moving activity in the preceding year, whichever is greater, is due April 1 and reported on ODOT Form 735-9208 (see Oregon Administrative Rule 740-055-0320). Fees received late are charged a penalty of 2 percent per month until paid. Under ORS 825.326, all fees, penalties, and interest are placed in a Consumer Protection Household Moves Account and used exclusively for administration and enforcement of Oregon intrastate household goods mover regulations.


Authorized Movers

When the origin and destination of a move are within Oregon, moving company rates and services are regulated by the Oregon Department of Transportation, Motor Carrier Transportation Division. Following is an alphabetical list of authorized household goods movers. Some movers have broad authority, some have authority tailored for specific commodities or special services, and some have authority to serve within certain city areas. Movers with a Class 1C Certificate can transport household goods for-hire in local cartage situations, including within the commercial zones of Astoria, Coos Bay, Eugene, Klamath Falls, Medford, Salem, and Portland. This service is subject to state economic regulation governing entry into the business and the rates that are charged for service. Movers with a Class 1B Permit can transport household goods for-hire in local cartage only within certain designated small Oregon cities (see ORS 825.240). Specialized Movers

Movers may have authority tailored for specific commodities or special services. Many have authority to serve within certain city areas. Movers with a Class 1C Certificate can transport household goods for-hire in local cartage situations, including within the commercial zones of Astoria, Coos Bay, Eugene, Klamath Falls, Medford, Salem, and Portland. This service is subject to state economic regulation governing entry into the business and the rates that are charged for service. Pack & Loaders

Many businesses offer a specialized labor service packing and loading household goods. This is advantageous for consumers who want to rent a truck and move themselves, but not do all the packing and heavy lifting. Advertisements for pack and loaders appear in the Yellow Pages and Classifieds alongside ads for regular movers. As a result of legislation passed in 2009, House Bill 2817, businesses that provide a specialized labor service packing and loading household goods are not regulated by the Oregon Department of Transportation. Effective October 1, 2009, Oregon law specifies that pack and loaders are exempt from motor carrier regulations if they don’t provide or operate a vehicle for moving household goods or act as an agent for someone who does provide or operate the vehicle.
