Rules Proposed:
OAR 813-205-0085, Low-Income Weatherization Assistance Program

Caption: The Multifamily Energy Program Manual is being updated for the next two quarters

Summary: The rules will address protocols, standards, and requirements with respect to the Multifamily Energy Program Manual. The rules provide clarification to program operations specific to verification processes and eligible pathways for projects. Updates to the Multifamily Energy Program Manual as follows:
(1) An independent third party must follow RESNET sampling protocols.
(2) Projects may pursue only one bundle in the Bundled Path.
(3) RESNET Guidelines for Multifamily Energy Ratings are to be followed

Summary: OHCS no longer has authority for these rules. 2017 SB 310 transferred authority to the cities and counties. The rules need to be repealed so as not to confuse the public.

Notice of Public Hearing
For the Sale of Tax-Exempt Single-Family Mortgage Bonds
State of Oregon
Housing and Community Services Department
 
The Oregon Housing and Community Services Department (the "Department") will hold a public hearing at 8:30 a.m. on  Thursday April 12, 2018, in Room B-221 at 725 Summer Street NE, Suite B, Salem, Oregon, at which time any person may be heard regarding its proposed plan of financing. The Department proposes to issue tax-exempt single-family mortgage bonds to finance and/or refund bonds that were used to finance the acquisition, construction and improvement of owner-occupied residences for qualified persons in the State (the “Program").  The bonds will be issued in one or more series, in an aggregate amount not to exceed $200 million, over not more than a 3-year period, pursuant to a common plan of finance. 
 
The Department will consider the information obtained at the public hearing and take appropriate action that it may deem warranted including submission of a transcript of the hearing to the Governor, or State Treasurer, who must approve or disapprove, pursuant to Section 147(f) of the Internal Revenue Code of 1986, the issuance of the above-referenced tax-exempt bonds to finance the Program.  It is the intention of the Department to issue these tax-exempt obligations on behalf of the State, the first of which is expected to be June 2018.
 
All interested persons are invited to present comments at the public hearing (or to forward their written comments to the Department at the address shown below) concerning the issuance of the bonds and the purpose therefore.

Caption:  Updating the Individual Development Accounts (IDA) to clarify the role between Department and its designee

Summary: The proposed rule changes will allow Neighborhood Partnerships to align the IDA Standard Operations Procedure. The Department worked with DOJ to assist with minor editing changes and clarify the roles between the Department, the Department’s administrative designee and the fiduciary organizations.

OAR 813-205-0000 – OAR 813-205-0150, Multifamily Energy Program

Caption:  Amending rules for the Multifamily Energy Program

Summary:  The Multifamily Energy Program is designed to address energy efficiency needs of low-income households in multifamily housing. The rules are being updated in response to the Governor’s Executive Order 17-20 to expand the multifamily program. The proposed rules extend its scope by expanding income requirements and extending offerings on a year round basis outside of the current funding processes. The rules address protocols, standards, and requirements of the Multifamily Energy Program.

Temporary Administrative Rule Filing
OAR 813-330-0030, 813-330-0040 - Wildfire Damage Housing Relief Account

Subject: Amends date of loss and grant amount.

Summary: The 2017 Oregon Legislature adopted changes to the Wildfire Damage Housing Relief Account in HB 2742. The rules reflect the statutory changes made, including changing the income eligibility to access the fund and raising the limit on assistance to $7,000 per eligible applicant.

These temporary rules are in effect until August 8, 2018.

Caption:  Adopts permanent rules to implement the Rent Guarantee Program
Summary:  The 2017 Oregon Legislature enacted legislation, HB 2724, that directs Oregon Housing and Community Services Department to develop and implement the Rent Guarantee Program to provide incentives and financial assistance to landlords that rent or lease to low income households by guaranteeing payments to landlords for unpaid rent and for eviction and property damage costs within certain limits.
