On November 9, 2012 at approximately 4:49 p.m., OSP troopers were dispatched to a report of shots fired call at 877 Dick George Road in the Cave Junction area. Subsequent investigation indicated that two people in a pickup arrived at the property occupied by ROBIN LAVON SMITH, age 44, and her two teenage children. The two people identified as DAVID BARRETT, age 28, and MARISA ZABALA, age 26, were acquainted with SMITH and came to retrieve a hand tool that had recently been left outside the residence.
After retrieving the hand tool, BARRETT was returning to the pickup when SMITH came outside and fired one shot from a handgun narrowly missing BARRETT. BARRETT got into the passenger side of the pickup and as they were leaving two more rounds were fired from the handgun. One of the 3 shots entered the pickup bed and struck a dog, killing it.
The initial investigation by OSP Criminal Investigation Division detectives and patrol troopers led to SMITH's arrest on several charges. She was lodged in the Josephine County Jail on the following charges:
* Attempted Assault in the First Degree (2 counts)
* Unlawful Use of a Firearm (2 counts)
* Animal Abuse in the First Degree
